Been a long time since we last gave an update. But here are some changes in construction law that took place in the 2013-2014 time period: (taken from California Construction Law blog) AB 44 Amends the Subletting and Subcontracting Fair Practices Act to require that prime contractors disclose the CSLB license numbers of subcontractors who will perform work on public works projects beginning July 1, 2014. AB 195 Existing law authorizes counties to enter into design-build c...ontracts for the construction of buildings and wastewater treatment facilities in excess of $2.5 million through July 1, 2014. The new law extends that authority until July 1, 2016. AB 1336 Existing law requires the California Labor Commissioner to issue a civil wage and assessment penalty against a contractor or a joint labor management committee to bring an action against a contractor no later than 180 days after the filing of a valid notice of completion or 180 days after acceptance of a public project, whichever occurs later. The new law permits the Labor Commissioner to issue a civil wage and assessment penalty against a contractor and a joint labor management committee to bring an action against a contractor up to 18 months after the filing of a valid notice of completion or 18 months after acceptance of a public works project, whichever occurs later. The new law also requires that contractors, when providing payroll records to a joint labor committee, disclose the names of workers and in certain cases the last 4 digits of their social security number.

Changes to California Construction Laws in 2012: A number of significant changes to California construction statutes take effect over the next year. The first group of changes caps the amount of retention that can be withheld on public projects and shortens the time in which progress payments to subcontractors must be statutorily made on public and private projects, both of which took effect January 1, 2012. Second, sweeping modifications to California law governing mechanic...s liens and stop notices become effective July 1, 2012. Third, subcontractor interest groups championed major modifications to California's "anti-indemnity" statutesmodifications that are generally very protective of subcontractors. The ramifications are so far reaching that these changes do not go into effect until January 1, 2013. Contract forms and contract administration need to be adjusted in light of each of these changes to avoid inadvertent forfeiture of important rights and unenforceable contract provisions. See more
