What a way to start the new year - Devin wins before the Ninth Circuit this morning! In this case, the client was represented by another lawyer and convicted at trial. The sentence included a mandatory minimum 3 year sentence, and the judge forfeited to the government the client's family home. Devin convinced the 9th Circuit to reverse on the most serious convictions, and the Court gave strong guidance that the forfeiture was too severe. A remarkable victory!

A significant victory this week for our firm. As we prepared to go to trial in a case involving a client stopped at the San Clemente checkpoint with five kilograms of controlled substances hidden in a fire extinguisher, the government dismissed the case with prejudice. The client, a young woman who was free on bail, no longer faces years in federal prison.

The Sentencing Guidelines play a critical role in federal criminal cases. Today, I (Jeremy) was appointed as the 9th Circuit representative to the Sentencing Commission's Practice Advisory Group. I feel honored to serve as one of the voices of the criminal defense lawyer's community, and hope to have an effect on national sentencing policy.

Congratulations to Devin for winning yet another Ninth Circuit appeal today!! He's on a remarkable roll, with victories piling up this year! In this fraud case out of the Central District of California, Devin argued the district court judge erred in two significant ways at sentencing. The Ninth Circuit Court of Appeals agreed, and reversed the district judge's decision. The case will now be returned for resentencing, and the client should get a significantly lower sentence. Huge victory for our firm. After a state superior court judge, a state appeals court, a federal magistrate judge, and a federal district court ruled against our client, Devin took over the case. He briefed and argued the case to the Ninth Circuit Court of Appeals a year ago, and today, the Court ruled our way! Our firm just won an important case before the Ninth Circuit Court of Appeals. In United States v. Moser, the Court reversed the district court's order slashing attorney fees for a prevailing party in a civil asset forfeiture case.
