We are sad to announce that TONIGHT is the LAST night we will be lighting up historic downtown Benicia with our Christmas lights, as ordered by the City Attorney. We do not agree with silencing our First Amendment Right to expressing our Freedom of Religion but the City of Benicia has required we turn off our Christmas Lights we are told because of one or two complaints. Our Christmas Lights will turn on at sunset tonight and turn off at 8pm for the final time. We wish you al...l a VERY MERRY CHRISTMAS! UPDATE: Sadly this announcement has sparked into a larger controversy. The City Attorney is now claiming he did not require me to turn off the "Christmas Lights" and that the stands holding up the lights are "...both illegal, unsafe, and placed on public property". The "light stands" have been inspected by a certified Civil Engineer as a requirement by the City of Benicia, and deemed safe, in writing. What he is NOT saying that City Council passed an updated Sidewalk Dining Ordinance in April of 2019, at my urging. I complied with every step of that ordinance, and as such submitted an application for Encroachment Agreement with the City of Benicia - per the City's direction. The city did not require an encroachment agreement prior to investing in the improvement, only that an application be submitted by the end of 2019. Our application was submitted in July 2019. The city was actively involved with the process of installing the patio improvement with multiple inspections, each time direction was given we made the required update. The City of Benicia only added "turning off the Christmas Lights" to the requirements approximately three weeks ago because of complaints from "one or two upstairs neighbors". Every requirement by the City of Benicia has been completed for our Outdoor Dining / Sidewalk Dining Patio. The City Attorney continues to be unreasonable, and unwilling to work with us to finalize the encroachment agreement, instead the City Attorney has complicated the issue by a last minute add-on requiring our Christmas Lights to be turned off. And here we are, complying with yet another city requirement. It seems the City Attorney won't be satisfied until he puts The Loft Wine Bar & Restaurant out of business.
