Big time dismissal today on a felony grand theft and 2nd degree burglary. Most unusual case I've had in 20 years. Client was adamant that he was not the guy in the surveillance video at the Lowe's in Sonora alleged to have stolen property from that store. The classic SODDI (some other dude did it) defense. Turns out SODDI! Met with DDA and made the case with surveillance video. This was a Tuolumne County case and they are tough up there. That said, I appreciate that DDA Hovatter (the only DDA out of three I dealt with that agreed to meet with me) listened patiently as I made my case after which he said he will dismiss the case against my client. It was a 2 year battle..

R.I.P. Frank Carson, a colleague who was a fearless and effective advocate for his clients. He had the killer cross-examination. I learned a lot from Frank. Gone too soon.
