California lawmakers mistakenly applied AB 5 to us interpreters/translators. Will they fix the law or let women & professionals of color like me go under? What about the limited English proficient (LEP) people I serve in my very own community on the daily? They will certainly suffer, too. Check out this powerful piece by my esteemed colleagues Barry Slaughter Olsen and Katharine Allen of InterpretAmerica just published in the Bakersfield Californian. The facts show we’re independent professionals, not misclassified workers. https://www.thecalifornian.com//translators-sa/4466324002/

WARNING THERE ARE TWO SIDES TO EVERY STORY: MARY LEE BEHAR was hired by my office Tony Barriere Interpreting Service to interpret in the Romanian language for a half day MSC at the Wcab in Van Nuys on 11-4-19. She agreed to charge $450 for 3 hrs. which is her half day rate. My office instructed her to be at the Wcab in Van Nuys at 9am. At about 11:10am the applicant attorney came out and told Mary Behar that the morning session was done and the case was going to be contin...ued to the afternoon to read the settlement documents to the applicant and was told to come back at 1:30pm. Mary Behar decided on her own to stay at the cafeteria at the Wcab in Van Nuys. After she had been informed to come back at 1:30pm at about 3:15pm she came up to me and told me that she had been on the clock over 6hrs and that she needed to be paid above her full day rate. I informed her that the full day would be over at 4:30pm since she was told to come back at 1:30pm for the afternoon session. I also told her I don’t pay for lunch breaks nor have I ever paid for anyone’s lunch break in the 30yrs I have been in business when working at the Wcab. She then proceeded to threaten to leave if I did not pay her for lunch break because she claimed that she couldn’t take another job during that time. I told her that if she left before the 3hrs hours were up I would not pay her for the pm session. She then left and without my knowledge went to talk to my client (applicant attorney) and threaten him as well stating that if she did not get paid for her lunch break she would leave. The applicant attorney then went to talk to the Defense attorney because they needed to settle this case and the D.A begrudgingly agreed to pay her an extra $150.00. It was very unprofessional and unethical of her to have talked to either the A.A or D.A regarding her pay. I consider her actions to be blackmail and extortion and I would never hire this interpreter in the future. See more
