Now, San Diego Judge Wohlfeil ruled on Wednesday (12/16) that the State order requiring restaurants to close, is unenforceable. Then today (12/17), the judge clarified that his ruling "is intended to encompass all restaurants within the county of San Diego." The Judge indicated that the State had failed to show how restaurants and strip clubs have contributed to the virus' spread or shortage of hospital beds. As a result, San Diego County has suspended enforcement of its restrictions barring indoor and outdoor dining and live entertainment in the county. The State is appealing the ruling.
Los Angeles Superior Court Judge Chalfant rules (on 12/8) that LA County failed to assess the economic impact which the dining ban would have on restaurants, owners, and staff - and that the County cannot issue such an impactful order without assessing all the risks of enacting it. Judge Chalfant noted, Government agencies and the media are generating fear and thriving on fear and the evidence shows that healthy Americans need not fear, ... This is so sad, and represents such a double-standard.
Tenants definitely need help in these tough times, as do the landlords. A resolution to help both sides is necessary, to avoid catastrophe.
The threat came, and now it's official, as New York gets sued by restaurant owners for the shut down and not being allowed to re-open indoor dining.
It will be interesting to see how the overall issue of past-due rent is handled between landlords, tenants, banks, and the government.
In these challenging times, adhering to the guidelines (as difficult as they initially are), can ensure potential shut-downs for non-compliance.
Something needs to give. The insurance companies are getting away with murder by denying these claims - but if they had to pay them all out, they would go bankrupt too.
This is just the tip of the iceberg...
These drastic reductions in capacity will be having a long-lasting negative effect on businesses which may not be able to recover.
When the larger chains are suffering, you can only imagine how badly the smaller independent locations are suffering. What lessons can we learn from these bankr...uptcies and closures?
