May Is Small Business Month In an official proclamation, the Governor declared May as California Small Business Month in recognition of the importance of small businesses and entrepreneurs to the state. California is home to 3.8 million small businesses, the most in the nation and 99.8 percent of all businesses in the state. As part of the observance, the Governor’s Office of Business and Economic Development (GO-Biz) is hosting a series of small business forums and webinar...s for the benefit of our small business community. This month the state is launching the new Jump Start program, which will make direct loans of $500 to $10,000 to small business owners that need financing to get to the next milestone and continue on a path toward success. The Jump Start program officially launched on May 9 and is administered by the California Infrastructure and Economic Development Bank (IBank) within GO-Biz. California Community Colleges have also partnered with GO-Biz for Small Business Month and announced a series of free events offering valuable information and resources to help small business owners succeed. CYBER-ALERT: Smishing Attacks Are On The Rise Smishing (SMS phishing) is a text messaging scam that has been on the rise, according to cybersecurity experts. Smishing is similar to older email phishing scams and the bottom line is identity theft. A smishing attack uses a text message to trick an unsuspecting target into divulging valuable information, such as an account or card number, card expiration date, password/pin, Social Security number and the like. Once obtai...ned, attackers can use the information to generate, among other things, counterfeit ATM cards. It can take as little as one hour from the time the information is obtained for an attacker to conduct a fraudulent cash withdrawal. Financial institutions can help fight this cyber threat in the following ways: Educate your customers about potential threats related to this type of crime. Ensure card processing and fraud rule configurations are made to help reduce the likelihood counterfeit cards can be used. If possible, subscribe to a brand abuse mitigation service. The vendor can help expedite the take-down of the attacker’s number. Work with law enforcement when the scam is actively occurring with your customers. Ensure your cybersecurity incident response program, procedures and processes are up-to-date. FRAUD Beware - This could happen to you... Did you know that the California Association of Realtors has a NEW Wire Fraud Advisory form, the CAR WFA? Click Here to review a draft of this form and help spread the word to your fellow agents.... The battle goes on involving e-mail hacking and the focus of thieves on real estate, lenders, banks, title company, settlement/escrow company and other businesses. The perpetrators seek to steal money from the depositories and service providers commonly using faked e-mails. A lawsuit involving forged wire instructions was filed on May 16, 2016 by First American Title Company against Tanisha Zapata and others as Case No. BC620704 at Los Angeles County Superior Court at http://www.lacourt.org/ . First American Title Company contends that the Defendants hacked the e-mail of the real estate salesperson to send false wire instructions for the Seller's proceeds at closing. First American Title Company states that the e-mail appeared to be genuine and as such the Escrow Officer followed the false instructions and wired out the funds. Although the identification of the perpetrators is not completely clear at this time it should be resolved as the case matures. First American Title Company had to come up with $513,000+ to balance the escrow. It then sued persons named in the Complaint, including the real estate agent whose e-mail was hacked, claiming that under California Civil Code Section 1798.81.5 he failed to "implement and maintain reasonable security procedures and practices to protect the personal information of the Seller from unauthorized access, use, modification or disclosure." It is extremely important to protect your clients NPPI and consult with your attorney regarding your procedures in handling e-mails from clients/purported clients to change wire instructions. And, always, stay alert!!! The California Department of Justice at https://oag.ca.gov/ecrime/databreach/reporting states that California law requires a business or state agency to notify California residents whose unencrypted personal information is hacked. SAFETY TIPS FOR HOLDING A SAFE OPEN HOUSE If possible, always try to have at least one other person working with you at the open house. ... Download the App: Emergensee Upon entering a house for the first time, check all rooms and determine several "escape" routes. Make sure all deadbolt locks are unlocked to facilitate a faster escape. Make sure that if you were to escape by the back door, you could escape from the backyard. Frequently, high fences surround yards that contain swimming pools or hot tubs. Have all open house visitors sign in. Ask for full name, address, phone number and email. When showing the house, always walk behind the prospect. Direct them; don't lead them. Say, for example, "The kitchen is on your left," and gesture for them to go ahead of you. Avoid attics, basements, and getting trapped in small rooms. Notify someone in your office, your answering service, a friend or a relative that you will be calling in every hour on the hour. And if you don't call, they are to call you. Inform a neighbor that you will be showing the house and ask if he or she would keep an eye and ear open for anything out of the ordinary. CONSUMER FINANCIAL PROTECTION BUREAU FINALIZES TWO-MONTH EXTENSION OF KNOW BEFORE YOU OWE EFFECTIVE DATE Washington, D.C. The Consumer Financial Protection Bureau (CFPB) today issued a final rule moving the effective date of the Know Before You Owe mortgage disclosure rule, also called the TILA-RESPA Integrated Disclosures rule, to October 3, 2015. The rule requires easier-to-use mortgage disclosure forms that clearly lay out the terms of a mortgage for a homebuyer. The Bur...eau issued the change to correct an administrative error that would have delayed the effective date of the rule by at least two weeks, until August 15, at the earliest. The Bureau is finalizing Saturday, October 3 as the effective date. The Bureau believes that moving the effective date may benefit both industry and consumers with a smoother transition to the new rule. The Bureau further believes that scheduling the effective date on a Saturday may facilitate implementation by giving industry time over the weekend to launch new systems configurations and to test systems. A Saturday launch is also consistent with industry plans tied to the original effective date of Saturday, August 1. The final rule issued today also includes technical corrections to two provisions of the Know Before You Owe mortgage disclosure rule. State Reduces Water Use by Nearly 29 Percent The state’s urban water users substantially improved their conservation efforts in May, according to the latest drought response report from the State Water Resources Control Board (Board). Urban water districts reduced their aggregate consumption by 28.9 percent compared to the same month in 2013, the report said. That compares to the 13.6 percent reduction recorded in April. The May savings rate was the highest recorded since G...overnor Brown called on all Californians to conserve water in the face of limited supplies. Enforcement and compliance statistics reported for the month of May also indicated that water suppliers are following up on water waste complaints and issuing formal warnings and penalties against alleged violators. Complaints are a very important tool for identifying leaks and overwatering that could go undetected for weeks resulting in millions of gallons of wasted water. See more

In the current issue of the Mar Visa View newsletter, that was dropped at your door a couple of weeks ago, is an insert that gives you pointers on preventing crime and the 5 Points of Contact of who to call when 911 doesn't work. (its attached below)... You need to be the eyes and ears of your neighborhood and call in any suspicious activity. No one knows your neighborhood better than you. Dear Friends, Universal Protection Service, our contract Security company, has notified us that President Obama is scheduled to be in Los Angeles on October 9th and is expected to remain overnight. President Obama is scheduled to arrive at LAX at approximately 2:00 p.m. on Thursday and is scheduled to speak at the Cross Campus in Santa Monica, which is located at 820 Broadway and is also expected to appear at a shared office complex at 929 Colorado Ave.; these two locations ...are just a block away from each other. The President is also scheduled to attend a fundraiser in the evening in Brentwood. They may be some protest activity. Expect traffic delays on the Westside beginning tomorrow around 2:00 p.m. with the 405 and 10 freeways being affected. The greatest impact will be in and around Santa Monica, especially Lincoln Blvd., Wilshire Blvd., Cloverfield and Pico Blvd. President Obama is scheduled to remain in the area overnight. There is no information on his schedule for October 10th, but expect traffic delays throughout the Westside on October 10th. No specific information on road closures has been published.

Put your car keys beside your bed at night.Tell your spouse, your children, your neighbors, your parents, your Dr's office, the checkout girl at the market, everyone you run across. Put your car keys beside your bed at night.... If you hear a noise outside your home or someone trying to get in your house, just press the panic button for your car. The alarm will be set off, and the horn will continue to sound until either you turn it off or the car battery dies.This tip came from a neighborhood watch coordinator. Next time you come home for the night and you start to put your keys away, think of this: It's a security alarm system that you probably already have and requires no installation. Test it. It will go off from most everywhere inside your house and will keep honking until your battery runs down or until you reset it with the button on the key fob chain. It works if you park in your driveway or garage. If your car alarm goes off when someone is trying to break into your house, odds are the burglar/rapist won't stick around. After a few seconds, all the neighbors will be looking out their windows to see who is out there and sure enough the criminal won't want that. And remember to carry your keys while walking to your car in a parking lot. The alarm can work the same way there. This is something that should really be shared with everyone. Maybe it could save a life or a sexual abuse crime. P.S. I am sending this to everyone I know because I think it is fantastic. Would also be useful for any emergency, such as a heart attack, where you can't reach a phone. A lady suggested to her husband that he carry his car keys with him in case he falls outside and she doesn't hear him. He can activate the car alarm and then she'll know there's a problem.

If the solicitors become persistent or refuse to leave, advise them you are notifying the police and report the details to the Non-Emergen...cy Dispatch at 1-877-275-5273. Be aware that another trend has been Distraction Burglaries. In these incidents a person posing as a utility worker, roofer or tree trimmer knocks on your front or side door and tells you they need to access your back yard. The suspects will lure you into the back of your residence while a second suspect will enter through the front and quickly ransack areas inside the home seeking small valuables and cash. In most cases the suspects stay in contact and communicate by cellular telephone or two way radios. Other methods of operation have been female suspects who claim their pet or small child went into your backyard. Recently, I received an email at my LAPD work email indicating that my bank account was compromised and that I needed to log into my accounts to verify my information and credit card information. They provided a format to log in with my user name and password and provided a link. The logos and emblems looked very authentic. This is a phishing scam! Just to reiterate, if you receive anything from anywhere unsolicited, DO NOT RESPOND! Solicitors, regardless of if they are selling a product, seeking a donation or, political in nature, should be turned away. If someone knocks on your door and says you have to step out of your home, especially to go to your back yard, CALL 911 Immediately!
