Congratulations to our client who recently won a 100% award at trial, prevailed after the defendant filed a Petition for Reconsideration at the WCAB, and when the defendants appealed the WCAB decision by Writ to the Court of Appeal, our attorneys pointed out to the Court of Appeal the numerous cases that had already established the law on the issues being appealed, so the court specifically found there was no reasonable basis for the petition and punished the defendant by o...rdering they pay attorney fees in connection with the Writ. In this day and age of abuse by carriers with Utilization Review and Independent Medical Review with little repercussions on the defendants, it is nice to see even a conservative Court of Appeal, like that in the Fourth District, punishing the defendants for their abuses and delays. Hopefully, our client will finally get paid on her 100% award. Of course, the battles with medical care on her case continue, but our office will continue to appeal every Utilization Review denial as is needed to continue her care.
