Several people have reached out to me recently over concern about social posts from two local women that are creating and selling "badges" that say "Can't Mask,... Don't Ask" along with the acronym ADA over the tagline "Disability Rights are Human Rights". While these women are not Gretna residents, they did speak at a Gretna Public Schools board meeting recently to oppose masks. Those reaching out were concerned about the legitimacy of these badges and whether they were potentially illegal. I have reached out to several local authorities to inquire about this issue along with doing some research and here's what I can share with certainty. While the legality of the creation of these badges isn't clear, what is clear is that these badges are being created as a fraudulent means to avoid following requirements to wear masks. The clearest summary I found came from a recent USA Today article: How the law is currently getting described is that everybody has protections under the ADA, and that is certainly not true, Harris said. For disability rights to be meaningful, individual assessment and analysis was made key to the law. This means that there is no blanket protection the ADA provides people; each disabled person receives unique accommodations according to their needs, contradicting the central claim of the viral posts and cards. Even if a person could identify their disability and prove that not wearing a mask without any other precaution was a reasonable request, the business could still turn that person away based on the direct threat that they posed to others, according to Roberts. A direct threat under the ADA is any substantial risk to the health and safety a disabled person poses to others, which cannot be countered with reasonable accommodations. Often, disabled people will ask for other accommodations like curbside pickup or delivery for their groceries and other needs, he said. The Americans with Disabilities Act does not allow anyone, disabled or otherwise, to ignore mask requirements without other precautions being taken. The ADA does not offer blanket protections; accommodations are specific to individuals. Viral claims stating otherwise are not based in any government guidance or law and have been denounced by the Justice Department. We rate this claim FALSE because it is not supported by our research.
