Yesterday, Cal/OSHA revised its emergency temporary standards to allow fully vaccinated employees to work without masks along with other changes to normalize the workplace. The revision comes within a couple of weeks of the original decision, with California having administered 39 million vaccine doses and record low case rates. Sarah Evans attended this week’s ribbon-cutting for Balboa Park’s newest signage at the Golden Hill Grotto, which many don’t realize is part of Balboa Park. Sarah serves as the board chair of the Friends of Balboa Park, the nonprofit that helps enhance and maintain the park through philanthropic dollars. The grotto is believed to be the oldest designed decorative feature in Balboa Park built in the early 1900s and was a major attraction during the 1915 Panama-California Exposition. #BalboaPark #SanDiego #history

CLIENT WIN: John Schena recently prevailed at arbitration in a matter where a minority shareholder demanded millions of dollars and involuntary dissolution of a company with nearly $50 million in annual revenue. John represented the company and was able to prove the majority shareholder did not breach his fiduciary obligations, distributions of retained earnings to the shareholders were not necessary, and that the minority shareholder had unclean hands that prevented him from properly seeking relief. Thanks to John’s efforts in litigation and Ross Schwartz’s efforts in advising the company, our client is able to keep more than 40 people employed. John and Kristen proved the brokerage firm breached its fiduciary obligations and as such, no damages were awarded. Instead, the broker was ordered to pay the client’s attorneys’ fees expended in having to defend the litigation. NEW CA LAW: Effective 1/1/2021, a state-wide law will require employers to notify employees exposed to someone who tested positive for COVID-19. Currently, if an employer learns an employee is diagnosed with COVID-19, the San Diego County health order requires the employer to promptly notify the County Department of Public Health and provide notice of potential exposure to anyone regularly present at the workplace. Attorney Ali Adelman attended today's invite-only San Diego County Bar Association "Briefing with Congressman Scott Peters" that featured numerous insights into what is coming down the pipeline in Congress: Congress is heading back to Washington D.C. soon to approve the next federal funding bill. They will also consider a new COVID funding package, which may be similar to the previous one but with smaller amounts of assistance. They will also consider a bill Mr. Peters introd...uced that would standardize COVID reporting among states. Mr. Peters is optimistic about getting the Postal Service back on track, and hopes San Diego will have more representation and be more influential in Congress in the coming years.
