Bankruptcy is not a giveaway that someone is irresponsible. As stated by the Judge there are often many contributing factors that are out of one's control such as illness, divorce, loss of a job, etc.

While I do not believe that schools should lie, I find it very very difficult to believe that students -- before enrolling -- cannot figure out the odds of going to ANY school in any profession. I have known since I was 13 years old that some schools are a joke, others are not, that some statistics for lawyers ranged from $13,000 / year salary and up. If you don't go to a "good" school your odds of working "big law" are not good and ... lawyers ... like police officers, doc...tors, teachers ... are good and bad. I have also known than anyone who makes up their mind to do something will get it done. Virgin Airlines? Gore Vidal? No degree. I also knew my father was paying for my schooling and I could "go wherever I wanted to go." I knew this for as long as I remember being on the planet. Just as I knew when I decided to go and pay for it myself, I was not going to rack up debt without a commitment to having a plan to reduce that debt. Had I NOT had a father and mother to pay for my schooling I would have had a higher burden of due diligence. Why are we exempting everyone under 18 from their due diligence? When I decided to go to law school I had weighed graduate programs for 15 years Been accepted, wait-listed, researched, deferred and could not make up my mind but LOVE school. I knew where I could and could not go and what I did and did not want to do to pay for that schooling. How do we blame a school when we don't assess our own expectations? I have so much to say about this topic - I cannot put it all in a post on facebook. But my grandma and grandpa did not make it past 8th grade. They left a legacy and they NEVER would have fallen for this mortgage crisis, they NEVER would have run up hundreds of thousands of dollars in schooling that they could not afford, nor advised their children to do so. We are losing our common sense and watching too much TV. School is not a guarantee if you don't look inward to what you WANT and how to GET THERE rather than childishly and blindly blindly following some dream based on no research whatsoever. Part II: How to Find a Lawyer: Continuing from Part I in an effort to ease your frustration in finding a lawyer. We move on to Bar Associations - volunteer bar associations that may or may not have a referral service of their own. They are smaller associations. Attorneys join them for a fee and usually the association offers assistance to the community and other lawyers in many ways such as outreach to the community and CLEs for attorneys. For your purposes, you may find a bar association close to where you live with referrals to lawyers in your area. You may identify with the lawyers within that bar association. These are great resources for seeking legal assistance.

I am also going to direct you to free and low cost assistance. Finding a lawyer should not be frustrating when you have a starting point. You also need to know how to protect yourself and we'll discuss that as well.

Before you pay to have your loan modified make sure you are not paying up front fees for nothing. What promises are being made? Are they legitimate? Do they have happy clients that will verify results? NO ONE can promise results in a loan mod and attorneys may not take up front fees for loan modifications.
