New law on Prison Priors: On October 8, 2019, the Governor signed Senate Bill # 136, amending Penal Code section 667.5, subdivision (b). A prisoner cannot get a one-year prior prison term enhancement, except when the defendant has a qualifying prior for a sexually violent offense. The amendment is effective January 1, 2020.

For about the past month, I’ve seen my timeline flooded with people’s response to watching ‘When They See Us.’ Well, I’ve been watching that recording for the p...ast decade; I see it a lot when I meet Black and Brown men charged with serious and violent felonies. I see it over and over again when they tell me about how the police lied, or profiled them. Tragically, not everyone who may find time to watch it from a couch take the effort to watch it up close. Just make sure that if you want to add your two cents into the conversation, get informed about this process. Get informed about the players involved in this war. Know your county district attorney, know who your county judges are, sit your ass in a jury pool. Because when it’s my turn to go to war for one of these young kids and I need faces from their communities to stand as their peers in judgement, a lot of the people are too busy at work, or with their families, or simply too busy to be bothered. And I’m left telling their stories to the folks in the suburbs, who have time today. So, you want an opinion about the film? Well, be a part of it too. See more

WARRANT CLEARING EVENT: The Sacramento County Sheriff’s Department is always looking for new ways to better serve our community. With the holidays rapidly appr...oaching, the Sheriff’s Department is hosting a warrant clearing event, which will be held on November 12, 2018, from 8:00 A.M. to 5:00 P.M. at 7000 65th Street in south Sacramento. This event will allow members of our community to come in and obtain new court dates for their respective qualifying warrants without the stress of having law enforcement contact during the holiday season. The Sheriff’s Department understands life moves at a fast pace and there are a variety of reasons why a warrant may be issued. This warrant clearing event will help foster relationships between the Sheriff’s Department and the community we proudly serve. In addition to the community benefit, this will also present an opportunity for the Sheriff’s Department to mitigate the thousands of active misdemeanor warrants in Sacramento County. We have watched young people use DACA as a springboard to find better jobs, attend school and support their families. This is a sad time, but we are committed to continuing to help the immigrant community. The Law Offices supports the end of the death penalty in CA. Vote YES on Prop 62 and NO on Prop 66. Here are some key reasons why: 1. Abolishing the death penalty would save the state $150 million dollars a year, according to the state is non-partisan Legislative Analyst. The cost of killing a person is 18 times more expensive than it is to sentence him to life in prison without parole. The savings could be used to implement proven measures to prevent crime. 2. The impositi...on of the death penalty is not foolproof. Innocent people have been executed in the past and, so long as we have capital punishment, innocent people will be executed in the future. DNA technology and new evidence have proven the innocence of more than 150 people on death row around the country. In California alone, 66 people had their murder convictions overturned because new evidence proved they were innocent. A study by Michigan law professor Samuel Gross estimated that 1 in 25 inmates sentenced to death across America from 1973-2004 was innocent. 3. Despite decades of research, there is still no credible evidence that the death penalty serves as a deterrent. 4. The idea that an execution brings closure to the victim's family is a hoax. Most people don't feel measurably better about the death of their loved one after his/her killer is executed. The real travesty is that the appeals necessary to try to prevent a deadly mistake keeps these families in an uncertain limbo for 20 to 30 years. 5. There is practically nothing in Proposition 66 that would actually speed this process up. The initiative actually creates additional layers of review by sending habeas petitions to the trial court and then the Courts of Appeal before they go on to the Supreme Court. The only thing that could actually hasten things is a provision that allows courts to appoint less than qualified lawyers to handle the appeals. But, of course, this increases the chance of a wrongful conviction. Jeanne Woodford, the former warden at San Quentin captured the essence of Prop. 66 when she described it as a "poorly-written and confusing initiative that would add layers of government bureaucracy, inundate courts, and increase taxpayer spending on prisons at the expense of other priorities." BIG RECENT LAW MOVEMENT, to make prosecutors accountable for keeping evidence from the defense. The State Bar Board of Trustees just passed Rule 5-110. It will now go to the California Supreme Court for approval. If approved, it will subject prosecutors to discipline for failing to make timely disclosure of any evidence or other information which tends to negate guilt or mitigate the offense, including at sentencing, if the prosecutor had knowledge of the evidence and reasonably should have known of its exculpatory value, regardless of whether that evidence is "material". Also, the Governor signed AB 1909, which subjects a prosecutor to felony charges for failing to disclose material exculpatory evidence.
