Robert Ernenwein, Criminal and DUI Defense Attorney

My jury in San Fernando Court today returned for deliberations and ultimately informed the court they were deadlocked 11 to 1 for acquittal. The court on its own motion dismissed the case and my client has been released. Six days of jury trial and deliberation. This is my second jury trial of the year both of which have resulted in positive outcomes for my clients.

Beginning jury selection on my third jury trial of the year in Department A of the Los Angeles Superior Court, San Fernando. Although I settle many of my cases it is important that when considering retaining an attorney you hire someone ready and able to take a case to jury trial when necessary. Robert

9th Circuit of the U.S. Court of Appeals Chief Judge Alex Kozinski. A man with an incredible intellect and a true moral compass. A fearless defender of the Constitution. A man who does the right thing regardless of the consequences.

Interesting statistic. Contrary to popular belief, our state incarceration rate rose as the crime rate was relatively stable.

It is an excellent piece of legislation that allows for 1st time offenders to avoid a criminal conviction. Listened to lectures today by Barry Sheck of the Innocence Project and Bryan Stevenson of the Equal Justice Initiative whose book Just Mercy is on the NY Times best seller list. The worst nightmare of any lawyer (and I think everyone) is to have an innocent person convicted of a crime. It was frightening and compelling to hear true stories of just this. When Judges, prosecutors and defense lawyers fail in doing their jobs, wrongful convictions can occur. What I took away ...from today is two things. First, that it is important that the guilty be convicted and society protected. But also, and even more importantly, that when any one of us in the criminal justice system fail in our duty, we run the risk of convicting the innocent. This includes Judges that tolerate perjury, prosecutors who do not disclose exculpatory evidence and seek convictions at any cost and defense lawyers who do not meet their obligations to fight for their clients by investigating their cases and scrutinizing the government's case. Not a day I will soon forget. And yes, it was better than playing hooky and going to the Pro-Am, even though I came very close to doing so. See more
