While law enforcement officials want a reliable way to determine when a driver is "too high" to operate a motor vehicle according to a Columbia University study it is difficult to document high driving in a relevant and reliable manner. The reason is that tetrahydrocannabol "THC," the psychoactive ingredient in marijuana, is fat soluble and absorbed differently than alcohol. THC moves from water environments, like blood, into fatty tissues which absorb it, and release it slo...wly in the blood stream. Accordingly, THC levels are more difficult to determine unlike a "breathalyzer" which itself has a host of flaws. On the other hand, when you drink, alcohol spreads through your saliva and breath. It is absorbed and saturates in your lungs and blood. The theory behind the notion of reliable alcohol level detection is that measuring the volume of alcohol in one part of your body can predictably tell you how much is in any other part of your body (although not true in the absorptive phase), and how much is affecting your brain's ability to perform divided attention tasks such operating a motor vehicle. Marijuana is not like that. The height of your intoxication isn't at the moment when blood THC levels peak. In addition, your high doesn't rise and fall uniformly based on how much THC leaves and enters your bodily fluids. According to studies by the National Institute on Drug Abuse, THC clears out of the blood in occasional users within a couple of hours. While they still may be high, a trickle of THC leaches out of their brains and other fatty tissues back into the blood until it's all gone. Accordingly, a lab test could still find trace amount of THC in blood of occasional smokers after a few hours. As a result, it is currently too difficult to accurately and reliably predict the number of nanograms per milliliter of THC (the psychoactive ingredient) in marijuana that would allow a rebuttable inference someone was "too high" to drive. Traffic studies that rely on blood THC could also be inaccurate if blood is drawn too late and/or the THC has already left the system. Accordingly, a byproduct of marijuana metabolism that marks only recent exposure and not intoxication may result in an overestimation of marijuana-related accidents and as well as DUI arrests of drivers who are actually not under the influence. https://www-sfchronicle-com.cdn.ampproject.org//Some-state

This is not the first and only attack defense lawyers will have to endure. There is an attack on our entire profession as judges and prosecutors believe that they can impose their views, enforce laws by breaking them, then bend the narrative by coaching law enforcement witnesses while judges immunize them from attacks on their credibility. Our judicial system is broken and the notion that the judiciary is too closely related to and/or concerned about resentment or blowback f...rom prosecutor's office rather than the Constitution, is a sad reality in trial courts across this nation. Thankfully, this judge did not yield to those pressures. To boot, our jury system is antiquated and bent towards convicting when you allow "deliberation," which essentially allows stronger personalities to impose their will on weaker jurors. Simply solved, one vote after review or re-review of the evidence. If all believe that the accused is guilty, then he's guilty. If all do not agree, then there is reasonable doubt, and the accused is innocent. The notion that people, without real compensation, will sacrifice for something many have never read (i.e. the constitution and/or any portion thereof) for a "defendant" is a grave miscalculation and injustice. With more people 2.2 million people in prison, first to China with a population that dwarfs the United States, the notion of Justice William Blackstone is an idea far too long ignored: "the law holds that it is better that ten guilty persons escape, than that one innocent suffer." It is time for prosecutors, who withhold evidence, wrongfully convict people, and put on lying witnesses, to suffer the fate of the law which they ignore to get a conviction. I will say this, it is has long been time to hold prosecutors accountable for their unethical and harmful conduct, and by harmful I mean to the entire criminal justice system. Some, not all, prosecutors have acted with impunity for way to long. This is a tragedy on so many levels.
