Under the new AB 3088, to qualify for the eviction protections, tenants would be required to file declarations with their landlords that they are suffering financial hardship because of the COVID-19 pandemic. Under the compromise proposal, tenants can’t be evicted for nonpayment of rent this year from March to Sept. 1. They can continue to avoid eviction if they pay at least a quarter of their rent starting Sept. 1 and until Jan. 31, 2021, after which full rent would have to be paid.

Section 2 of the new law would also permit commercial tenants to serve notices demanding their landlords renegotiate their leases in good faith. If negotiations fail, tenants could then terminate their remaining lease terms, and any associated third-party guarantees, with no liability for the payment of future rent.

This is a summary of the current eviction law as it relates in Los Angeles County until May 30, 2020. In summary, all #evictions both for residential and commercial are stopped if you can show an impact based on #COVID19 and if your specific city has not previously enacted an ordinance that addresses rent. You will need to repay any amounts owed within a 12 month period after May 30, 2020. Your specific jurisdiction may be different.
The #COVID19 pandemic has challenged businesses and government in an unprecedented fashion. In response, the federal government has passed several pieces of legislation including the #FamiliesFirstCoronavirusResponseAct signed into law on March 18, 2020. Among the many provisions in the law, effective April 1, employers covered under the Emergency Paid Sick Leave Act and Emergency Family and Medical Leave Expansion Act (FFCRA) are required to post a new notice, the Families F...irst Coronavirus Response Act Notice. Covered employers include private US employers with fewer than 500 employees. The new poster articulates employee rights including paid leave entitlements, qualifying reasons and enforcement under the new leaves. The new model posting is attached here in both English and Spanish. According the Department of Labor guidance, to comply, each covered employer must post a notice of the Families First Coronavirus Response Act requirements in a conspicuous place on its premises. An employer may satisfy this requirement by emailing or direct mailing this notice to employees or posting this notice on an employee information internal or external website. Given the current state of the workforce, we are providing you with this posting electronically to expedite delivery and to help you meet the posting requirement sooner.
