You may have heard by now that Justice Scalia has died, likely of natural causes. He was appointed to the Supreme Court just a few months after I graduated from high school. He served for a long time. This has enormous implications for the upcoming elections. There will be pressure on the Republicans in the senate to allow a vote on an Obama nominee, but they will prefer to delay things until after the election. One of the presidential candidates, Ted Cruz, is on the Sena...te Judiciary Committee, which holds the initial hearings on an appointee, and has tremendous power to delay any vote on a nominee. If Scalia's successor is delayed until after a new president is sworn in, the court will effectively be 4-4 on many contentious issues, which means that any lower court opinion would be affirmed. You can think what you want about the current election (in my opinion, it is mostly a circus not worthy of the world's most powerful democracy), but this important issue is now front and center. The choice of a successor to Scalia will strongly influence our lives for many years to come. One final note. Three other Supreme Court justices were born in the 1930s (Breyer, Kennedy and Ginsburg). Thomas will be 68 later this year. In all likelihood, the next president will have tremendous power to sculpt the legal landscape of our country. Choose wisely.
