Audience: Living Trust Administration Was in my #santamaria office wrapping up the day and in comes three potential customers. They had with them a Living Trust binder and tons of questions. It was a sister, brother and the brother's wife. The siblings father passed away years ago and their mother just recently passed away. So, they were trying to administer their trust by themselves. Apparently, they had already sold a piece of property and used realtors for the sale, bu...t they still did not know much about what to do next with the remaining two properties and how to transfer them out of the trust and into their individual names. Luckily, I am knowledgeable at these types of matters. So, first thing is first, I need to see the last recorded #deed or last transfer document to ensure the real property was in fact funded into the trust properly. I had to do a search through #fidelitytitle and the deeds were no listed. Luckily, the sister found one of the deeds to the property and it did in fact appear to be titled into the parents' trust correctly. The second piece of property we still are not 100% sure, so the customer is going to request it from the #CountyRecorder in #sanluisobispo (I assume it will be properly titled into the trust, but we have to make sure first). As for the first property discussed, two Affidavit of Death of Trustee documents will have to be prepared in addition to a deed transferring the property from the "Successor Trustees," which happens to be the siblings as co-successor trustees, into the brother's name. It is a fair simply process, but one that can be extremely daunting if the process and procedure is not familiar. At the end, the customers were extremely happy and although I still have to prepare the documents, my fees are going to be around $400 versus probably $2000+ with an attorney (their fees vary, but tend to be much, much more than ours). Audience: #Living Trust #Estate Plan We like to share our customer’s experiences because often other customers have questions about our legal services and getting other people’s perspectives is helpful. At our #sanluisobispo location when we were wrapping up our meeting (went over and reviewed a customer’s #estateplan), the customer told me that she had heard from a friend of hers who had a #livingtrust prepared that is was like, pulling teeth. I am not 100% sure what sh...e meant by that, so I asked and she stated that her friend used #legalzoom online. I explained that #legalzoom has a good product, but that most of our customers prefer the hands on face to face service we provide, plus the cost is about the same. She further stated that, this was so simple, painless. We had a bit more small talk and she asked me for a few business cards as she wanted to refer her friends, one in particular that lives in #bakersfield (we are opening an office in #bakersfield in January, so it might work out). Lastly we talked about the need to keep her #livingtrust binder safe and that she should get a fire proof safe or a safety deposit box at a bank. See more

How a Power of Attorney turns into Guardianship and Probate? You never know when you will need legal help and when a legal matter or in this case matters will fall into your lap. Where to go? What questions to ask? One of the reason I am in this business is because I enjoy helping people resolve their legal matters. Since I am not allowed to give legal advise, I do not. Most matters simply require knowledge of how to navigate the legal system that can seem entirely daunti...ng and practically impossible to navigate, but with a little information, nudge in the right direction and common sense help, what seems impossible is actually quite probable. Here you go. A previous Power of Attorney customer of ours experienced a sudden death in her family; her sister passed away and left a 6 year old son behind. So, she is going to be petitioning the court for a guardianship of her nephew. Plus, there will be a simple probate for the sister's estate, which is not that large. All the family members are in agreement to the guardianship and probate, so the matter is somewhat simple in nature, but just requires quite a bit of legal document preparation. First thing is first, as for the guardianship we need to complete a questionnaire and gather all the pertinent information and family member's contacts. Then, prepare the Petition and related documents to be filed with the Court. A hearing date will be set and a court investigation will take place. The investigator's report drafted and filed with the Court for the Judge's review. If all goes well, which it should, at the hearing the guardianship will be granted. It is likely the aunt will want to adopt the child, but even though they are related an adoption is a pretty costly endeavor and can take many, many months. As for the probate, because there is no real property and the assets/debts are minimal, an Affidavit of Small Estate can typically be used to collect the assets and distribute them to the heirs at law. This is just a sample of what types of matters we get on a daily basis and how we help people with their matters without the customer's incurring outrageous legal fees. Can you put a mobile home in a Living Trust? Quick answer. Yes! There is a misconception that a Mobile Home cannot be funded into a Living Trust/Estate Plan. Honestly, it is not as simple as Deeding over the property, but it can be done with some tenacity...the Dept. of Housing and Community Development is entity to contact and where the registration and title need to be changed. If either/or the registration or title are lost, then it is pretty simple to request duplicat...e forms, but again there are forms and associated file/processing fees. If you show up to the Dept. without your completed forms, the transfer will eventually occur, but the forms should be much easier to complete but are not which causes frustration. Luckily, a service like ours has experience completing these forms and navigating they system. Also, sometimes the owner of the Mobile Home also owns the land underneath the unit, and in this case a transfer deed will need to be prepared and filed with the County Recorder. Unless you do this for a living and know the process, it is easy to miss a step that can cause the Living Trust/Estate Plan to not be properly funded and then the dreaded Probate process could come into play that the Living Trust/Estate Plan process is attempting to avoid. People do estate planning documents for the Peace of Mind, to protect their families and to avoid probate, so if you are not 100% sure of where to start and if the matter is just too complicated or confusing, we can help.
