Last month, the U.S. and China announced they would extend business, tourist and student visas to 10 years on a reciprocal basis. Under the new extension, Chinese nationals will be able to visit the U.S. multiple times during the 10 years instead of having to reapply for a new visa every time they travel, as is required currently. Some immigration attorneys and EB-5 watchers have warned that Chinese applicants interested in immigration to the U.S. may give up the EB-5 process... and simply travel on the 10-year tourist visa. A post by Laura Foote Reiff published in the National Law Review argues that the agreement between China and the U.S. is not a good reason for prospective immigrants to ditch EB-5. First, a tourist or business visa, even one that is good for 10 years, does not allow residency or even an extended stay for college, for example. The new rules are designed to ease the bureacratic challenges of travel between the two countries, encouraging opportunities for cultural and business exchanges. Immigrants looking to move their families to the U.S. in order to access its institutions of higher education or its entrepreneurial opportunities will need the more permanent solution the EB-5 visa can provide.

There is no indication at present that the program is in any jeopardy in the future. However, it is important for prospective EB-5 visa applicants to be aware of the risks and possible outcomes.
