At first blush, this case might appear to be bogus. This woman should take responsibility for her own actions, right? Maybe not. Unless this woman assumes the risk, the restaurant might be held responsible for her injuries. The law is not one size fits all and what might not seem like negligence very well may be deemed negligence. Interesting case. Not sure I agree that the lack of a knife caused this man to choke. However, with the cost of litigation, Popeye's will probably pay this guy something just to get rid of the case.

Don't share an insurance policy. Many times people will share an insurance policy with a loved one; husband, boyfriend, mother, father, etc. However, if you are involved in an auto accident that was caused by one of those loved ones (who is called a "named insured" on your policy), you cannot recover for your injuries under that policy. So, what does this mean? Because liability coverage under almost every single automobile policy extends only to injuries sustained by any p...erson OTHER than a named insured, you cannot recover any money for your injuries, UNLESS, you live with somebody else that has a separate automobile policy with uninsured motorist coverage. However, this is a very rare situation because most household members that share an insurance policy are very unlikely to have a separate one. Please protect yourself. If it doesn't save you a lot of money to be on the same policy as your household members, purchase separate policies. Deciphering insurance policies can be very tricky and what I provided above is just a little snippet of what they contain.
