BLOG: HOW TO GET CHILD SUPPORT FROM NON-CUSTODIAL PARENT IN CALIFORNIA Going through a divorce, or as the courts call it, marital dissolution is difficult. Not only are emotions running high, but if you are a parent, you are faced with a barrage of issues that you now have to handle by yourself. How do you tell the children that their parents are getting divorced? How do you pay for the household bills with one or no income, when before, the same household bills were bein...g paid by at least one income and maybe two? How do you obtain legal advice if you cannot afford it? What custody and visitation arrangements do you make that are in the best interest of the children and at the same time protect your rights as the custodial parent? This article is limited to the issue of child support. For further information regarding all issues involved in divorce proceedings, please call our office and we will be happy to help you. Both parents have a legal obligation to support their minor children in the manner suitable to the child’s circumstances. (Family Code 3900) This means that there is no standard per child, per month child support amount. Child support is payable by the non-custodial parent to the custodial parent. This means that if the child is primarily with one parent, the other parent pays child support to the custodial parent for the benefit of the children. Child support is required for minor children until they reach the age of 18 years old and complete 12th grade. That means if your child turns 18 before completing 12th grade, child support is payable until he or she completes the 12th grade. (Family Code 3901) The amount of child support is determined by a guideline established by the State of California, called the Statewide Uniform Child Support Guideline. (Family Code 4050 et seq.) This guideline takes into consideration many factors, including, but not limited to, the percentage of time each parent spends with the child, the number of children, net monthly disposable income of both parents, the tax filing status of each parent and amounts paid for health insurance. Family law attorneys have a program called Dissomaster, that performs the guideline child support calculation. If the income of the parties are known and provable, then child support per guideline should not result in heavy court litigation. In a contentious divorce proceeding, however, it may be necessary to prove a party’s actual income before obtaining an accurate child support order from the court. CHANGES TO MECHANIC’S LIEN NOTICE REQUIREMENTS Effective January 1, 2011 the following amendments were made regarding notice requirements relating to mechanic’s liens: Notice of Mechanic’s Lien... Prior to the filing of a mechanic’s lien, the property owner or reputed owner must be served with a notice of mechanic’s lien by registered mail, certified mail, or first-class mail, evidenced by a certificate of mailing, postage prepaid, addressed to the owner or reputed owner at the owner's or reputed owner's residence or place of business address or at the address shown by the building permit on file with the authority issuing a building permit for the work. Cal. Civ. Code. 8416 Those not in direct contract with the property owner must still serve a 20-day preliminary. Furthermore, the Mechanic’s itself must be recorded within 90 days after completion of the work or 30 days after the owner records a notice of completion or cessation. Cal. Civ. Code 8414 Proof of Service Requirements The mechanic’s lien must now contain a proof of service affidavit completed and signed by the person serving the Notice of Mechanic's Lien pursuant to subdivision Cal. Civ. Code 8416. A "proof of service affidavit" is an affidavit of the person making the service, showing the date, place, and manner of service and facts showing that the service was made in accordance with this section. The affidavit shall show the name and address of the person or persons upon whom a copy of the mechanic's lien and the Notice of Mechanic's Lien was served, and, if appropriate, the title or capacity in which he or she was served. Cal. Civ. Code 8416 It is very important that all the requirements set forth in Civil Code 8416 are complied with as failure to serve the mechanic's lien, including the Notice of Mechanic's Lien, as prescribed by this section, shall cause the mechanic's lien to be unenforceable as a matter of law. Cal. Civ. Code 8416. When to File a Complaint in Court to Collect Within 90 days of recording the Mechanic’s Lien, a complaint for enforcement of the mechanic’s lien must be filed, otherwise, the Mechanic’s Lien expires and becomes unenforceable. Today, we had the pleasure of giving one of our clients a check for $449,000 recovered on a construction mechanic's lien collection case. We took a construction collection case to trial, after defendants made a low offer to settle. After winning a judgment for over $380,000 at trial, Defendants appealed. The Court of Appeal just affirmed the judgment. Can I now say, I told you so? Feels good to win!!!

He was sentenced to 1 year in rehab in Newport Beach and 10 years' probation. By extension, can't kids who grew up poor and in a family and community of criminals claim the similar defense?
