This article and it's title are quite misleading. Note that, this does not mean the offender will not be punished. Nor does it mean that the arrest couldn't be used a a "prior" in order to enhance the punishments of subsequent violations. It does somewhat level the playing field with many other criminal offenses that are divertible and allow for one to avoid a conviction. The bill has not been passed and is not yet law. As it stands now, the laws already have very deviously created a much higher bar for people to have DUI convictions expunged from their record as compared to most all other crimes, including many other much more serious and violent offenses.
