USCIS Announces a Revised Naturalization Civics Test "The civics test is administered to applicants who apply for U.S. citizenship and is one of the statutory requirements for naturalizing. Applicants who apply for naturalization on or after Dec. 1, 2020, will take the updated version of the test. Those who apply before Dec. 1, 2020, will take the current version of the test. . . . The revised test includes more questions that test the applicant’s understanding of U.S. histor...y and civics, in line with the statutory requirements, and covers a variety of topics that provide the applicant with more opportunities to learn about the United States as part of the test preparation process. The revised test will not change the passing score, which will remain at 60%. Candidates must answer 12 questions correctly, out of 20 in order to pass. USCIS will maintain the current guidelines for statutorily established special considerations for applicants who are 65 years old or older and have at least 20 years of lawful permanent resident status. Immigration officials restore DACA and start accepting first-time applications following court order "Complying with a recent court order, the Trump administration on Monday reinstated a program created by President Obama to shield undocumented immigrants who came to the U.S. as minors from deportation, announcing it would accept initial applications for the first time in three years. The U.S. Department of Homeland Security said it would administer the Deferred Action for Ch...ildhood Arrivals (DACA) program under the guidelines crafted by the Obama administration in 2012. Starting Monday, DHS said it would grant approved applicants work permits and deportation deferrals that last for two years and allow DACA-holders to request permission to travel abroad under certain circumstances. Trump considers targeting birthright citizenship with executive order in his last weeks in office, report says "Birthright citizenship is the policy whereby anyone who is born in the US is immediately granted citizenship, regardless of whether their parents have citizenship or not. It's guaranteed under the 14th Amendment, which states in part that "all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States... and of the State wherein they reside." More than 30 countries mostly in the Western Hemisphere have birthright citizenship. Vice President-elect Kamala Harris is an example of someone who received their US citizenship in this way. Harris's Indian mother and Jamaican father were not yet US citizens when she was born in California in 1964, but she became a US citizen. ... Counter-arguments to birthright citizenship over the years say that the 14th Amendment has been misinterpreted. "The Citizenship Clause of the 14th Amendment was clearly intended to guarantee that emancipated slaves would properly be recognized as U.S. citizens," RJ Hauman, government relations director at Federation for American Immigration Reform, told The Hill. Hauman's group is an anti-immigration non-profit. "It is a fundamental misapplication of this clause that U.S.-born children of illegal aliens are granted automatic citizenship, much less the offspring of people who come here to simply give birth on American soil." Department Of Homeland Security To Abandon H1B Visa Lottery For Salary Rankings "The U.S. Department of Homeland Security has announced it will replace the H-1B visa lottery, in which foreign citizens with college degrees compete for limited slots, with a wage-based selection process prioritizing higher salaries. .... This effort would only affect H-1B registrations submitted by future petitioners seeking to file H-1B cap-subject petitions. It would be implemented for both th...e H-1B regular cap and the H-1B advanced degree exemption, but would not change the order of selection between the two. ... The program has recently been under attack for ostensibly undercutting the wages of domestic workers. Under the current program, however, the U.S. employer who seeks to engage a foreign worker is required to pay that applicant the prevailing wage rate as determined and published by the Department of Labor through regular salary surveys in the marketplace throughout the country. One of the complicating factors of this system is that any particular position may require individuals with varying experience and thus the prevailing wage rate depends on the level of seniority the employer requires. Senior workers will be paid higher wages while junior workers will be paid lower ones. This is more a problem of the way the prevailing wages are determined by the Department of Labor than it is about foreign workers coming to America to undercut domestic worker salaries. Raising the wage rates as contemplated may be attractive to more high skilled foreign workers, but may not solve the problem of filling much needed positions in the workforce since such wages may not be affordable to employers, who instead, may hire such workers online overseas at lower rates." http://ow.ly/DBIT50C6Hw6
