In a split decision (2-1), the Federal 9th Circuit Court of Appeals has sided with the Trump Administration and has allowed the end of Temporary Protected Status (TPS) for immigrants from El Salvador, Haiti, Nicaragua and Sudan. A previous case which included Honduras and Nepal is also affected by the decision. TPS has allowed for approximately 400,000 immigrants from the aforementioned countries to live and work legally in the US for decades. What you need to know: 1. A re...quest for an en banc (a request for the case to be decided by 11 judges) reconsideration will be filed. 2. If the request for reconsideration is denied, or if the original decision is upheld, a petition can be made to the U.S. Supreme Court to hear the case. However, the Supreme Court is not required to hear the case and the decision to do so is discretionary. 3. If the above fail, immigrants with TPS from Haiti, Nicaragua, Sudan, Honduras and Nepal will be given until March 2021 to repatriate before ICE can move to deport them. 4. If the above fail, immigrants with TPS from El Salvador will have until November 2021 to repatriate before ICE can move to deport them. 6. If a new administration is voted into office, the decision to rescind TPS for the aforementioned countries can be retracted. 5. People with TPS may be eligible for other forms of permanent immigration relief and should seek to speak to an immigration attorney ASAP.
