MORAN LAW FIRM FIGHTS TO ENSURE POST CONVICTION JUSTICE PREVAILS!! a. The Darkness On December 13, 2017, Our (soon to be) Client, was convicted in the Fresno County Superior Court of having violated California Penal Code Section 288.5Continuous Sexual Abuse. Our Client was sentenced, (on May 17, 2018), to a term of six years within the State Prison. Our Client’s first eligible Parole Hearing date was set for July of 2022.... b. Our Work Begins When Our Client came to ushe had just received a term of commitment to the State Prison. Immediately, our office began to work. A review of the file revealed serious issues which supported factual innocence. Our office presented this information to the Court through a new trial motion. We subsequently filed a request for release on bail pending appeal and a request for compassionate release. Although we were unsuccessful at this level, we understood the weight of justice rested with the Court of Appealto which we submitted an Appeal on Our Client’s behalf. c. Unrelenting Hope Through the difficult process, our office maintained contact with Our Client’s spouse. Although difficult, and seemingly the whole World against her, this Spouse maintained unrivaled optimism and hope that the system would persevere and justice would be administered. d. The Light At The End On December 10, 2020, the Court of Appeal filed a judgment for Our Client’s Appeal. In its sweetest form, the opinion states The judgment is reversed Our Client will soon be released; he will soon be sharing this holiday season with his loved ones! The Moran Law Firm could not be more excited for this Husband and Wife! They maintained patience and hopethey prayed, and maintained their bond of trust and love. In the end, justice shined on them both. If you or a loved-one have been convicted of a serious offense, and are uncertain of your post-conviction options, schedule a free consultation with the Moran Law Firm. Inmate Release Because of COVID-19?! Is this an option for my family member/loved one?? In this chaotic time, it is important to be well-informed. This is especially true regarding incarcerated persons. It is well documented that COVID-19 is highly transmittable and extremely dangerous when contracted. It is not as well known that prisons and jails escalate the danger of viruses because inmates, due to close quarters, have no way to isolate or protect themselves. As such, vi...ruses and illnesses, (such as the flu), tend to spread quicker and affect more persons than in the general population. Upon receiving this information, you may be wondering: What are MY optionsorWhat are the Options of Someone Who Is Incarcerated? Simply, the answer to both questions depends on where the person is located. If the person is in a county jail, they have the option of filing an Emergency Motion Requesting Immediate Release under the directive of California Chief Justice Tani Cantil-Sakauye. If the person is located in a Federal Institution, they may file an Emergency Motion For Sentence Modification Pursuant To Title 18 U.S.C. 3582(C)(1)(A). Qualified candidates for either of these types of motions include persons with significant health risks, the elderly, persons with nonviolent offenses, persons with minimum sentences. If your would like more information concerning these motions, feel free to refer to our information posted on the Moran Law Firm webpage, located at: http://moranlawfresno.com/ If you feel that your relative or loved one may benefit from this type of motion, please contact the Moran Law Firm for a free consultation.
