The CA Legislature recently passed a bill (AB 1885) to increase the homestead exemption for CA homeowners. Gov. Newsom has until September 30, 2020, to sign the bill. Under AB 1885, individuals who own their homes in the State of California, who are current on their mortgage payments, but living on modest income and drowning in debt, could be eligible to participate in the Chapter 7 Bankruptcy system, without the fear of homelessness as an end result. If you received a discharge order in a bankruptcy last year and received a 1099-C from one of your creditors, please review the following information from the IRS: https://www.irs.gov/pub/irs-pdf/i1099ac.pdf This information is also stated on the bottom left hand side of the 1099-C, in fine print.

According to an e-mail sent out by the US Bankruptcy Court, for the Southern District of California, "The courts are taking measures towards a goal of sustaining paid operations now until January 18, 2019. If existing funds run out and new appropriated funds do not become available, the Judiciary will operate under the terms of the Anti-Deficiency Act, which allows 'essential work' to continue during a lapse in appropriations. The Bankruptcy Court and Clerk's Office will remain open before and after January 18." Wondering how the partial government shutdown impacts your current Bankruptcy case? According to the U.S. Trustee in the Dept. of Justice, and the U.S. Bankruptcy Court for the Southern District of California, all scheduled 341(a) meetings will proceed as noticed, and the Judiciary will remain open and can continue operations through approximately Jan. 11, 2019, by using court fee balances and other funds not dependent on a new appropriation.
