BEWARE!! Reverse mortgages require the home owner to continue paying for property taxes and insurance. Reverse Mortgages have begun foreclosing on residences when homeowners fall behind on insurance or taxes.

The Feds blew it. If they capped student loans, the schools would have had to remain affordable, or go empty. The rumor is that the next bankruptcy law will make student loans dischargeable after seven years. It should be a good time to be a bankruptcy lawyer.

If you want to discharge taxes, the bankruptcy noticing address for the IRS, which has been designated to all of the bankruptcy courts, must be on the mailing list. Unless, of course, the case is in the 9th Circuit, and no assets are distributed.

Won an appeal today. 30 plus mistakes on the bankruptcy schedules. BAP held that the statue is a fraud statute, there has to be a misstatement, a reliances on the misstatement, and a loss to deny a discharge. This means minimal mistakes on schedules are irrelevant. The memorandum was not published, but has some argumentative effect.. Pull case Case Number: 16-1356 I really distrust trustees and lawyers who think a little mistake on schedules is fatal. ... Dennis
