Yesterday, I took the deposition of a 1031 tax expert witness regarding Revenue Procedure 2002-22. He is very highly credentialed and gave a very esoteric presentation based on a 20 page written report. However, he knew nothing about our case and claims that the attorneys who hired him told him nothing about the issues that were to be decided. They did this to protect him from rigorous cross-examination. I think it turned out very poorly for them.
