Signed into law on September 1, 2020 by Governor Newsom, AB3088 is widely known as the COVID 19 Tenant Relief Act of 2020. This law enacted many safety measures for tenants and requires landlords to comply with various requirements in order to evict or have the ability to pursue past due rents. But the new law also allowed for local jurisdictions to place stricter requirements. This has created large confusion amongst many landlords trying to keep up with rules that may or may not apply to their specific property. In this episode, I help alleviate the confusion with a summary of the law and a landlord’s duties to comply with the COVID-19 Tenant Relief Act of 2020.

The 2020 election sparked many emotions in American citizens. Besides voting for the next President, Americans also voted on many local propositions. In California, Proposition 19 was one of those. Even though it passed with approximately 51.5% majority vote, there is still a lot of confusion on this proposition and what it exactly does to property taxes. On the surface, just-case eviction ordinances sound like common sense but pose real world problems because it does not address HOW a landlord obtains proof of violations - Many lease violations are clear but documenting the proof can be difficult, and courts place the burden of proof on the landlord - Example: tenants complain to a landlord that another tenant is selling drugs from inside their apartment. There could be witnesses to this but how do you document it for the cou...rt? Does the tenant really have 20+ random friends entering and leaving their apartment daily? Police will not get involved unless they clearly see a crime occur but how, if the crime is happening inside the tenant's apartment. Some cities, despite the new statewide rent control law, want to enact stricter rent control measures. Study after study shows rent control does not help the housing market long term. It only helps tenants currently in place - Rent control encourages people to stay in units, so less vacancies come on the market. This drives prices higher. With the new rent control and just cause laws in effect now in California, there is a lot of talk about doing "trial runs" with tenants for under 30-days before signing a long term lease - First, what tenant will want to move in with the possibility of moving out in less than 30 days? This is too costly. A landlord will lose well qualified prospects over this. - Secondly, the just cause eviction protections only apply after a tenant has lived at the property for more than 12 ...months. - My recommendation is to do an 11 month lease and use those 11 months as your trial base. There is a lot of confusion from both landlords and tenants when it comes to "grace" periods on lease agreements - First, check your lease agreement for the stated grace period clause.
