Settled Federal Case for Defendant - Plaintiff’s claims primarily focused on the notion that Defendant had obtained money and/or accepted loans from Trustor by inter alia fraudulently inducing Trustor to provide funds to her for what Plaintiff’s alleged were nonexistent illnesses and disabilities; and defendant influenced Trustor to gain sympathy and took advantage of Trustor’s purported lack of capacity. However, Defendant showed that the Defendant’s illnesses and disabiliti...es actually existed and were supported by evidence including medical reports; that the money transfers were made voluntarily over a period of many years; were gifts and not loans, and presented a Board-Certified Neurologist Expert Witness report showing that the Trustor had capacity during the period of years over which the gifts were voluntarily provided to Defendant. The parties settled following a day-long Court Ordered Mediation. Suffice it to say that it was a relatively easy settlement for both in the case of a wealthy Plaintiff vs. fixed income retiree defendant. The case was dismissed with prejudice. See more
