Planned DUI checkpoint in San Diego tomorrow night (July 14). A few reminders... 1. Do not drive after consuming alcohol or controlled substances. Ride share or public transportation. 2. Anything you say can and will be used against you. Remain SILENT. 3. Do not do field sobriety tests! They are NOT pass-fail. They are designed to get you to incriminate yourself. 4. Contact my office immediately if you are arrested so we can save your license and fight any conviction. ... (https://www.nbcsandiego.com//dui-checkpoint-sched/2364030/) See more

It is heartbreaking to hear 100+ people throughout San Diego County were arrested last night during the George Floyd protests. This is not fair. If you or someone you know were arrested during a peaceful protest and need to speak with a criminal defense attorney, please contact me directly at 619-786-4541 or [email protected]. I will represent you pro bono and will work tirelessly to support your right to assemble.

Thank you Expertise for including my Firm on your list of Best DUI Lawyers in San Diego for 2020! It was surprise validation of all the hard work I put in for my clients on a day-to-day basis, emphasizing DUI arrests or convictions do not need to follow you around forever. If you or a loved one are arrested, I strongly encourage you to reach out and take advantage of my Free consultations. Here are some DUI case results over the last year I am particularly proud of: **0.08 B...AC arrest-->no criminal charges, no license suspension, arrest record sealed **0.19 BAC arrest-->illegally obtained blood suppressed, case dismissed, arrest record sealed **Felony 0.14 BAC DUI w/ injury arrest-->misdemeanor non-injury DUI probation **2nd DUI within 5 years-->house arrest in lieu of mandatory jail time **Felony 0.07 BAC DUI w/ injury arrest-->misdemeanor non-injury "wet" reckless **Multiple "expungements" granted to change previous convictions to dismissals #sandiego #lawyer #dui #duilawyer #freeconsultation #justice #expertise https://www.expertise.com/ca/san-diego/dui-attorney

What we heard from them was there were individuals who were deserving of a second chance, Stephan said. A bit of a tone-deaf remark from an elected official, but I still support this move toward removing names that should have never been included in the first place.

Another fun Monday evening at the CLP downtown clinic. Even had the opportunity to stay late to handle some extra walk-ins. And my student intern (Zakk) for the night was great!

I recently received a couple of questions regarding hit & runs for my mailbag, but my answer was getting to be too long so I thought I would do a long-form post overview. This is especially relevant now that the weather in San Diego (and across California) is bringing in some much needed rain over the next few days and road conditions will predictably become dicier. Mailbag time! Since people liked the last one, I will take some more questions for a new mailbag on the blog. Shoot me a message if you have a criminal defense question or issue you would like me to look further into... (The last one: https://holanlegal.wordpress.com//a-sample-of-questions-o/)

Wow, ruling by the New Jersey Supreme Court could invalidate over 20,000 DWI cases across 5 counties in the state. (https://www.nj.com//20k_dwi_cases_could_be_tossed_in_nj_af)

I would like to thank all of my past, current, and future military clients in honor of Veteran's Day. I enjoy fighting for your rights in the courtroom the same way you fight for mine all over the world.

Preface: Part of being an attorney--I will let you determine if this is an upside or a downside--is people constantly ask me questions or hypotheticals, even when I am out & about just trying to be a "normal" person. So, I have decided to start posting some of the questions I get on a daily basis with two caveats: (1) I will not use anyone's name; and (2) I will not answer any specific questions because those should be handled in a confidential setting. On August 28, 2018, Governor Jerry Brown signed Senate Bill 10 into law, eliminating California's current "cash bail" system, effective October 1, 2019. With the new law on the books, California becomes one of just a handful of states--others include New Jersey, New Mexico, and Kentucky, plus Washington, D.C.--to tackle criminal justice reform. While the main draw to changing the bail system is to allow more criminal defendants, regardless of socioeconomic background, to defend themselves from outside a jail cell, there are some obvious concerns to be ironed out over the next year.
