As many of you are aware, over the past year or two the focus of my legal practice has shifted more towards federal civil rights litigation. As I watched the sickening video of George Floyd's murder, I felt the same visceral reaction of horror and anger as everyone else. I also felt extreme sadness in knowing that these types of events are far more common than most people understand. There are countless victims, throughout the country, whose names are not engrained in the minds of the country. One such name is Marshall Miles. Marshall lost consciousness, and ultimately died, shackled facedown in a cell at the Sacramento County Jail with the knees of three deputies pressed against his shoulders and back. Their actions prevented Marshall from breathing, directly leading to his death. Like George Floyd, Marshall screamed out that he couldn't breathe and begged for air before losing consciousness. On Monday, my office took the step of demanding the deposition of the Sheriff of Sacramento County, Scott Jones. We want answers, but don't yet know if he's going to have his lawyers fight our deposition subpoena. Below is a copy of the press release that went out earlier today.
