Take care of your family. Set up a living trust. I went to the bank yesterday and was talking business with a young man behind the desk (late 20s) who did not know my line of work, at first. He was lamenting that his brother had just died (mid 30s) and that for the past several months he (because he’s the banker in the family) has had to deal with his brother’s house. I listened, because that's what I do. Among the other unpleasant tasks at the time, he found himself ha...ving to find a lawyer because his brother did not have a living trust. The first lawyer quoted a fee of some $17,000.00 to take the case through probate. The young banker could not believe that the charge was so high, but he read the statute and found out that that’s what the lawyer can charge in addition to filing fees and everything. He didn’t want to have to lose that much money from his brother’s estate, so he found another lawyer who said he would do it for $6,000.00. But he came to hate working with that lawyer who wouldn’t answer the phone, and wouldn’t return messages, and when he did return messages he was rude and almost angry that he was disturbed. The probate proceeding is still going on, and my young banker is still miserable. Without even knowing what I do, he told me that the very first thing he will do when this is over is to get his own living trust. As I sat there, I watched a decent young man having to deal with the tragic accidental and untimely death of his brother. That, alone, was too much misery for him. Then, having to find a lawyer who would treat him well and not take advantage of him at the worst possible time in his life it was painful for me to watch. In most situations, with a living trust the transfers can be automatic and nearly free; no need for a lawyer, and no need to wait for months. I hope nobody misunderstands me. There are plenty of good lawyers out there, and I actually know quite a few, myself, and I work with them. But the question is this: Why would anyone want to put his or her family through what this young man was having to go through? As he told me, not only was it really unpleasant and for lots of reasons, it was a waste of his brother’s money money that the family could have used but went, instead, to the cost of a court proceeding that was totally unnecessary in his case if there had been just a little planning a living trust.
