In our opinion, based on what we've seen firsthand and heard from someone who worked there, CarMax knows they are doing this. We heard they sometimes buy damaged vehicles at auction and fix them themselves all without reporting it to... Carfax or any other agency so there will be no outside record of it. We have helped people who have purchased a vehicle there at CarMax only to find out it was previously in an accident and rebuilt and painted before being sold to them. And I myself have seen two such vehicles during my own attempts to purchase, one being a Toyota Sequoia that I paid $150 to have shipped from one location to the one near me. Before shipping I asked them to confirm it had not been in any prior accidents nor been repainted at all. Later, when it arrived I inspected it and immediately could tell 6 body panels had been repaired and repainted. I then asked for a refund of the $150 to which I was told no. And while I absolutely hate when people say anything along the lines of "do you know who I am?" they only changed course and gave me an immediate refund when I gave them my business card. But what happens to everyone else who doesn't own a law firm that specializes in lemon law and dealer fraud? That's frankly where we come into the picture. In our opinion a recently filed Class Action may limit the Lemon Law rights of owners of the following vehicles if equipped with the 8L90 or 8L45 8-speed automatic transmissions: 2015-2019 Chevrolet Silverado 2017-2019 Chevrolet Colorado 2015-2019 Chevrolet Corvette... 2016-2019 Chevrolet Camaro 2015-2019 Cadillac Escalade and Escalade ESV 2016- 2019 Cadillac ATS, ATS-V, CTS, CT6, and CTS-V 2015-2019 GMC Sierra, Yukon, and Yukon XL, and Yukon Denali XL 2017-2019 GMC Canyon According to the class action filed, vehicles with this transmission may suffer from: slip, buck, kick, jerk and harshly engage, suffer abnormal internal wear, sudden acceleration, delay in downshifts, delayed acceleration, difficulty stopping the vehicle, and eventually require replacement of the transmission or its components (the Transmission Defect). Case 2:19-cv-11044-DML-DRG, Para No. 4, USDC Eastern District of MI, Southern Div. So if you or anyone you know owns one of these vehicles and receives a Notice of Class Action and does not want to be included in it they have to take the step to Opt Out by the listed deadline otherwise they will very likely be stuck in it. Therefore, it is my opinion that if the listed vehicle is in fact suffering the transmission problems described and you have given GM, through its dealers, a chance to fix it under warranty but they have failed, that opting out of such a class action is the wiser way to go and instead pursue an individual action where you can much more likely obtain full compensation including a proper repair, or enough money to get one, or even a repurchase. Even if fixed in the meantime, to be safe, why wait for the problems to come back? Why risk them using the same defective parts and it happening again beyond the powertrain warranty when it will then cost you an arm and leg to get repaired again? LemonBuyBack.com's advice - Don't blame the dealer when the manufacturer won't authorize repairs. We hear it all the time. People getting extremely mad at their dealer, blaming it for not fixing their car under warranty. But I tell them I've never met a dealer who didn't want to get paid by the car company to fix their vehicle and make them happy. Sounds obvious, but why would a dealer not want to get paid all so it can be yelled at by its customer? So my advice is to b...e nice to the dealer. They would like to help, and get paid to do so. Usually the only reason they can't help is because the manufacturer won't authorize the needed repairs. So put yourself in your dealer's shoes, imagine if you boss told you to come to work on a Saturday and told you they won't be paying you for that. That's the same thing the dealer faces, being told by a customer to pay for a repair. But if the manufacturer won't reimburse it, the dealer would go out of business if it had to give away parts and pay its Technicians and Service Writers all without getting paid. Finally, I've seen instances where the customer got so mad at their dealer the dealer actually wrote the customer's threats on the Repair Order. Why give the manufacturer ammo to avoid paying for your needed vehicle repairs? Likewise, I've seen where the dealer who liked its customer wrote on the Repair Order that even though they may not have duplicated the problem they believe their customer, ultimately leading to the repair being authorized by the manufacturer. I've even seen a case where the manufacturer liked the customer so much they agreed to buy back a vehicle despite not once verifying the problems! So be nice to people. When there's a problem under warranty, do bring the car in for repairs, and even if they are not fixing it, do be nice to everyone involved. New Vehicles are Becoming Like Cell Phones! Consumers are Upset! My name is Lina Nahhas, and I'm a Consumer Like You! I leased a 2016 Honda Accord 3 years ago. A month before my lease was up, I decided to finance my vehicle, and thought it was the best decision I made, well I was wrong. Just 3 weeks later I had issues with my GPS, Radio Sound System, and my Apple iPhone couldn't connect to my vehicle, or my software would restart on it's own. Also I'm now having trouble with... my doors locking. I thought it was just a one-time thing, I was WRONG! Previously I owned a 2002 Honda Accord the vehicle was great! I drove that vehicle for 300,000 Mi, until it died out on me. That's when I traded my 2002 Honda Accord for the 2016 Honda Accord. I don't blame the dealership because the dealership has helped me out in so many ways, I thank the dealership for putting up with my frustration. Though, I do blame the Manufacturer for building a vehicle and treating it like a cell phone. I personally don't have money to purchase a new vehicle every 2 to 3 years, maybe I have money to purchase a cell phone. Even purchasing a cell phone is expensive nowadays! As a Consumer, I am questioning each manufacturer, whether it's Honda, Ford, Toyota, etc... in my opinion why are you building vehicles with less quality?
