This week I achieved great dispositions for two of my clients: In the first case, my client was charged with possession of a controlled substance. She was unlawfully detained so I filed a suppression motion. Two motion dates came and went because the prosecution couldn't get their act together. Finally, on the third motion date, the case was dismissed by the prosecution in the "interest of justice," which is prosecutor speak for, "yeah, you wrote a really good motion, and ...we know we're going to lose, so we'll just dismiss the case." In the second, my client was charged with possession of a loaded, unregistered, firearm in public; he was looking at a minimum of 4 months in jail and a felony conviction. A client of mine had a marijuana case out of Orange County and missed his arraignment date...by 6 months, leading to a warrant being issued for his arrest. My client was charged with possession for sale, and marijuana sales, because he was a bud-tender at a collective that was in compliance with all applicable law. From day 1 I told him not to worry because it was an incredibly stupid case. At the last pretrial, the DA didn't share the same sentiment, and would not let my guy go without a felony. A client came to me because he was unhappy with his previous counsel, as the attorney had accomplished nothing in five months, and wouldn't return phone calls. I sub'd in on the case as counsel of record today, and after discussing the case with the prosecuting attorney for the better part of the day, I was able to get three of the four counts dismissed, including a felony-strike, and plead my client to one misdemeanor count, which he was totally good for. Just resolved a case where my client was charged with two felony strikes for assault with a deadly weapon and criminal threats. My client signed a confession and was totally good for it. His potential State Prison exposure was five years, and the DA's offer, at the last pretrial, was 2 years. Happy Constitution Day! What better time than now, to take a step back and think about our constitutional rights, and how they are slowly, but surely, being eroded? From the internet to the street, your government is always keeping a watchful eye on you. To avoid becoming the proverbial frog that boils to death, I encourage everyone to really think about how much liberty and freedom you are willing to trade for "security." As Benjamin Franklin said, "Those who would give up Essential Liberty to purchase a little Temporary Safety, deserve neither Liberty nor Safety." We are engaged in a war with no end in sight, but if we cede our constitutional rights, the pillars of our society, the war has already been lost.
