Domestic Partners Special rules apply to domestic partners. Since not all states recognize domestic partnerships, it is important to check the laws of your particular state to learn how property is distributed upon your death. Generally, if you die without a will and are survived by a domestic partner, your domestic partner inherits the same as a surviving spouse, depending on how you owned the property. Because state laws vary, it is important to check the estate planning la...ws of your particular state. CALL OUR OFFICE NOW FOR A FREE 30-MINUTE CONSULTATION See more

TIME TO REVIEW YOUR TRUST : - Has it been more than 5 years since your last trust review? - Has your spouse or parents passed away? - Have you acquired additional assests which need to be included in your trust? Significant changes in the Federal Estate Tax Laws may mean that you no longer need a BYPASS TRUST (A-B TRUST) to avoid estate taxes. A bypass trust restricts the surviving spouse's use of the property, requires a separate income tax return, and assets in the bypass t...rust do not receive a stepped up tax basis upon the death of the surviving spouse. Probating a Will - As a general rule, a will has no legal effect until it is probated. The probate of a will means proving its genuineness in probate court. Unless otherwise provided by statute, a will must be admitted to probate before a court will allow the distribution of a decedent's property to the heirs according to its terms. AVOID THE LENGTHY AND COSTLY PROCESS OF PROBATE! CALL OUR OFFICE NOW AND ASK YOUR QUESTIONS! Robert Ferris: Author, "Understanding Probate, How To Handle The Decedent's Estate" Get a copy: www.probateattorneysanfrancisco.com What is Probate?... "Probate" is a legal process that deals with the assets and debts left behind after someone dies. By default, probate is supervised by a court, called the probate court. Note that the term "probate" can be used to describe the legal process, the court in which the process takes place, or the distribution of assets. The probate process can include all aspects of estate administration, such as: 1. Proving the validity of a will, if it exists, 2. Choosing an estate administrator, executor, or representative, 3. Totaling all assets both in and out of the estate, 4. Paying all applicable estate taxes and other debts, 5. Identifying all heirs and other relatives, 6. Distributing any remaining assets to the heirs as described in the will or intestacy statutes. Probate typically begins when the deceased's representative files a petition along with the death certificate in the probate court. The process generally ends when the court formally closes the estate.

A WILL DOES NOT AVOID PROBATE by Attorney Robert Ferris, "the Attorney who cares" Over the years I have noticed some common misconceptions about Wills. For example, some people believe that because they have a Will their estate will avoid probate when they die. Nothing could be further from the truth. For example, if you make a Will leaving your home to your children that Will must be probated. The cost to probate such a Will depends upon the value of the decedent’s est...ate. If you own a home valued at $800,000 when you die, the probate fees will be approximately $40,000. A Trust on the other hand not only avoids probate, but it provides a mechanism to control how assets will be distributed: (1) to small children and young adults who are not able to pay home mortgage, insurance and repair costs; (2) to persons with special needs who might otherwise lose their government payments in the absence of a special needs trust; (3) a Trust also eliminates MediCal’s ability to seek recovery for medical expenses which can total hundreds of thousands of dollars.
