ALERT: USCIS will extend, through Oct. 4, 2021, Temporary Protected Status (TPS) and the validity of certain TPS-related documentation (Form I-766, Employment Authorization Documents (EADs); Forms I-797, Notice of Action; and Forms I-94, Arrival/Departure Record) for beneficiaries under the TPS designations for El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan, provided that the affected beneficiaries remain individually eligible for TPS. Beneficiaries under these TPS designations may also apply for new EADs, if they wish, according to the procedures set forth in the Dec. 9, 2020, Federal Register notice (FRN).

DHS announced Tuesday that the U.S. may soon begin sending asylum-seekers at the U.S.-Mexico border to El Salvador under a bilateral accord. DHS stated that the two countries have concluded the implementation accords for the asylum-sharing agreement. Under the agreement, signed in Sept. 2019, migrants from other areas of Central America who request asylum in the U.S. may be sent to El Salvador instead. Humanitarian advocates have fought against the asylum cooperation agreements the U.S. has with Guatemala, Honduras and El Salvador because these three countries make up the dangerous Northern Triangle region. It is currently unclear how President-elect Joe Biden would approach the accord.

USCIS officially announces reinstated DACA. USCIS announced on Monday that, as a result of an order from a federal judge in NY, it is reinstating the DACA program effective Dec. 7. As a result, USCIS is now accepting first time DACA applications, DACA renewals, applications for advance parole, extending one-year grants of deferred action under DACA to two years, and extending one-year EADs under DACA to two years. DHS may still seek relief under the judicial order.

California federal court vacates interim final rule strengthening H-1B program. On Friday, USCIS announced that an order issued by the U.S. District Court for the Northern District of California vacated the Strengthening the H-1B Nonimmigrant Visa Classification Program Interim Final Rule (IFR). The Dec. 1 order prevents the IFR from taking effect, and also prevents DHS and USCIS from implementing the IFR. USCIS announced it will fully comply with the court’s decision. The IFR was originally scheduled to go into effect on Dec. 7 with the intent to protect U.S. workers, improve the integrity of the H-1B program, and better ensure that H-1B petitions are approved only for qualified beneficiaries and petitioners.

1st Circuit mulls burden of proof rules for immigration bond. On Wednesday, the First Circuit seemed likely to uphold a lower court ruling shifting the burden of proof in immigration detention cases from the immigrant to the federal government. The government was fighting a ruling which struck down the government’s initial burden of proof that forced immigrants to prove they are not dangerous or a flight risk to be freed from detention during their immigration proceedings. However, one circuit judge doubted whether this shift would even harm the government, with the rest of the panel appearing to share a similar concern. The appellate panel is currently reviewing the November 2019 decision that is being challenged.

After October 02, 2020 DHS will now require separate filing fees for Forms I-765 and I-131 when filed concurrently with Form I-485 or while it is pending with USCIS. Until now, adjustment applicants have been able to submit applications for employment authorization and a travel document for no additional fee while USCIS adjudicates their adjustment application. This will no longer be the case. Individuals who wish to work or travel while their adjustment applications are pend...ing must pay an additional $550 to file Form I-765 and $590 to file Form I131. Furthermore, DHS is eliminating the reduced child fee for Form I-485. While children under the age of 14 years old have only paid $750 to file Form I-485 (when the child concurrently files with a parent)11, they will now pay the full fee of $ 1,130. See more

USCIS fee increases may significantly lower the number of citizenship applications. USCIS will increase many fees beginning October 2, 2020. Among those increases is the fee for citizenship applications, which will increase from $640 to $1170.

Students on F-1 visas doing OPT must enter employer information in the system. On August 18, USCIS published a reminder for those on F-1 visas doing post-completion Optional Practical Training (OPT) to enter their employer information into the SEVIS system. Designated School Officials (DSOs) must enter the information as well. If the information is not entered into the system, it could lead to the student exceeding employment limits or otherwise improperly complying with requirements, which could lead to a loss of status.

The results for the 2021 Diversity Visa have been released. Last week, the State Department published its Visa Bulletin for September 2020, which includes the results for the fiscal year 2021 Diversity Visa. The top countries represented in the results are Egypt, Iran, Russia, Algeria, and Sudan, with several other countries also included in lower numbers. The number of entrants was lower this year due to a Trump administration policy requiring foreign nationals to have a passport to enter the drawing. Those chosen in the drawing can now apply for the visa.

USCIS has implemented new DHS guidance on DACA. On August 24, USCIS published an update clarifying DHS’ guidance on DACA. USCIS will reject all new DACA applications and limit renewals to one year. Existing two-year renewals will not be affected. Additionally, USCIS will reject DACA renewal applications received more than 150 days before the current DACA period expires; the agency clarified that applicants should file for a renewal between 120 and 150 days before their status expires. USCIS also included information on how it has limited advanced parole for DACA recipients to leave the country for urgent humanitarian reasons or a significant public benefit only.
