I did this case differently than some of the others, by throwing in everything but the kitchen sink, even arguing the CHP Officer from the Capitol Protection Section, should stick to guarding the capitol grounds rather than illegally detaining our clients for DUI. The officer’s statement had t...he arrest time at 10:30 a.m., the arrest at 11:45 p.m., and the blood draw before the arrest at 11:19 p.m. I argued this officer had no right to accuse my client of being impaired based on all of the mistakes he made in his reports, and no responsible person would rely on his paperwork in conducting their most important affairs. And, since there was no foundation under the evidence code, the document was inadmissible hearsay. I also argued that based on the totality of the circumstances there was a prolonged detention and no probable cause for arrest. Finally, a shout out to Stan Dorrance who testified that based on my client’s drinking pattern, i.e., his last drink with dinner was 10 minutes before the stop, his BAC at the time of driving was no more than .06-.07 depending on the burn off rate at the time of the stop. It helped that he essentially agreed with the blood result of .092% drawn 50 minutes after driving. Great news today in Santa Rosa. Felony 273.5(a) domestic violence charges dismissed. This was a tricky case since my client's girlfriend who he lived with at the time had bruises on her neck consistent with strangulation. However, our trauma expert disputed causation which was consistent with our client's version of what had really happened that evening. There has been a lot of talk lately about a rigged criminal justice system. But, in my opinion, nothing is more rigged than our local DMV driver safety office, when it comes to APS hearings on DUI cases. In Minnesota, the folks at the DMV administer driving tests and let the judges hear the APS implied consent hearings. The court conducts the hearings according to the same rules of evidence that governs civil trials. I find it offensive that the DMV hearing officers here ...admit the department forms and police reports into evidence and then make legal findings on 4th Amendment issues. Simply put, most people around here, have simply grown accustom to losing at our local Santa Rosa DMV. But, every now and then, you get a hearing officer who understands the law and does the right thing. I am so happy for my client Vince that a bay area hearing officer did his job, carefully reviewed the evidence and the law, and did the right thing, by ordering a set aside of his driver's license suspension, even though the blood test result came back more than 4 times the legal limit. The hearing officer agreed that the blood draw was unconstitutional because the Pleasant Hill police officer didn't obtain a warrant before ordering the blood draw. It's results like this, that give me the strength and fortitude to continue doing what I do, to help my clients get the best possible results for their cases.
