What purpose can stories serve in brief writing? Stories can be both compelling and persuasive. We remember stories. They speak to our sense of empathy and our desire for emotional connection. How can we, as attorneys, harness the potency of stories when writing our briefs? Consider this: nothing kills the impact of your case more than a recital of the testimony or cold listing of the facts. I am not suggesting that the story be fiction or go outside the record. To the contra...ry, it is imperative to reference the record with each point made. It is equally important to fairly set out all significant facts, including facts that may be unfavorable to your position. Where, then, is the space for stories within such a regimented format? We turn to great non-fiction to guide the way. While stories are often associated with fiction, we can also find excellent story-telling within the realm of non-fiction literature. For example, David McCulloch and Eric Larson write beautiful, non-fiction works with spellbinding stories, all based on facts. We must weave storytelling together with facts and compelling language if our briefs are to lay a more successful foundation for our cases.
