Computerworld reports on CBP's proposal that visa waiver applicants be asked to disclose information about their "online presence" in their arrival/departure records (Form I-94W) and their online application for an Electronic System for Travel Authorization (ESTA). The article quotes AILA's Director of Liaison Betsy Lawrence as stating, "[T]here is concern people could be denied (entry) for reasons that are not necessarily warranted. It sort of feels a little bit like a fishing expedition." On Monday, the American Immigration Lawyer Association (AILA) joined a number of human rights and civil liberties organizations in a sign-on letter urging CBP to withdraw this proposal.

Today is a sad day. The U.S. Court of Appeals in New Orleans ruled Tuesday in a 2-1 decision that the federal government wasn’t likely to win the appeal.
