http://youtu.be/VU1-ZTJ3x_8 Absolutely thrilled that a former client was so pleased with his representation that he took the time to make this video on his own! He did such a great job explaining the EDD appeal process and how the Law Office of Cyrus Mor can be of assistance. Thanks again, Daniel!

Your employer will likely be present at your unemployment appeal hearing. Your employer may bring witnesses to the hearing who can provide additional testimony regarding your separation from the employer. Similarly, you may also bring witnesses to your hearing. Your witnesses will be permitted to provide relevant testimony to corroborate any contentions made by you at the hearing.

Don’t quit your job and expect to be approved for Unemployment Insurance in California. An individual is disqualified for unemployment compensation benefits if the director finds that he or she left his or her most recent work voluntarily without good cause. (California Unemployment Insurance Code Section 1256). Don’t make the mistake of assuming that you have good cause to resign without first speaking to an Unemployment Lawyer in your state.

Being terminated by your employer does not automatically disqualify you from the ability to receive Unemployment Insurance in California. If you are denied Unemployment, on appeal, the Administrative Law Judge will determine whether the employer has met their burden of establishing that you were discharged for misconduct connected with the work. Misconduct connected with the work is a substantial breach by the claimant of an important duty or obligation owed to the employer, willful or wanton in character, and tending to injure the employer (Maywood Glass Co. v. Stewart (1959) 170 Cal.App.2d 719).

Our firm is often asked whether Unemployment Insurance Benefits are appropriate for a particular individual based on that employee’s economic status and occupation. A common misconception is that Unemployment Insurance is only proper for those who come from low-income levels and working class occupations. However, our clients come from diverse income levels, occupations, and education levels. While it is true that some of our clients are from industries such as food and bev...erage, retail, and construction; we also have retained educators, attorneys, paralegals, and employees with post-graduate degrees such as MBA's and PhD’s. Simply put, an employee's eligibility for Unemployment Insurance is not solely based on income level, occupation, or education level. Eligibility for Unemployment Insurance Benefits is determined by considering a multitude of factors delineated by the Employment Development Department (EDD).
