Your employer will likely be present at your unemployment appeal hearing. Your employer may bring witnesses to the hearing who can provide additional testimony regarding your separation from the employer. Similarly, you may also bring witnesses to your hearing. Your witnesses will be permitted to provide relevant testimony to corroborate any contentions made by you at the hearing.

Don’t quit your job and expect to be approved for Unemployment Insurance in California. An individual is disqualified for unemployment compensation benefits if the director finds that he or she left his or her most recent work voluntarily without good cause. (California Unemployment Insurance Code Section 1256). Don’t make the mistake of assuming that you have good cause to resign without first speaking to an Unemployment Lawyer in your state.

Being terminated by your employer does not automatically disqualify you from the ability to receive Unemployment Insurance in California. If you are denied Unemployment, on appeal, the Administrative Law Judge will determine whether the employer has met their burden of establishing that you were discharged for misconduct connected with the work. Misconduct connected with the work is a substantial breach by the claimant of an important duty or obligation owed to the employer, willful or wanton in character, and tending to injure the employer (Maywood Glass Co. v. Stewart (1959) 170 Cal.App.2d 719).
