Effective 01/01/2017 in CA, the rules for how much ownership in a Corp, LLC or Partnership an individual must have in order to be able to exclude themselves from Workers' Compensation Coverage will increase from the current minimum of 2% to a minimum of 15%. This change is going to be particularly harmful to family owned businesses that have multiple children working in the business who are now excluded from coverage (meaning that they employer doesn't have to pay premiums o...n their pay). Whereas up until now a family business with four children working in the business would have to give only 8% ownership to them in order to have them excluded, they will now have to give them 60% if they want to continue excluding them. The obvious result of this change, and the main reason for the new rule, in my opinion, is that many currently excluded family members and minority owners will have to have their payroll included in the Workers' Compensation premium calculation which in turn will increase premiums and tax revenues to the State. Passed by the legislature with little fanfare, it is just another burden being placed on businesses in CA. See more
