Throwback to finding out I passed the California Bar exam. _ California conducts what is considered the United States’ most difficult bar examination, the California Bar Exam, twice a year (in February and July). The net time of the exam is eighteen hours, spread over three days. The first day has three essay questions in the morning, and a performance test in the afternoon. The second day has applicants answering 100 Multi-state Bar Questions in the morning and afternoon eac...h. The third day follows suit with the first one. I’ve been increasingly working on cases involving mild Traumatic Brain Injury (TBI). Mild TBI is a serious injury that is often overlooked and misdiagnosed. _ A TBI is an alteration in brain function or other evidence of brain pathology caused by an external force (but does not have to be a direct blow). Brain tissue becomes distorted or deformed in the process of TBI. The momentary deformation of brain tissue is enough to produce a TBI. _ It is critical to understand that ...in mild TBI cases, the MRI scans and CT scans are almost always normal. - Do not fall victim to the insurance company trap that there is no brain injury because the emergency CT scan or MRI scan was interpreted as normal. If the scans show evidence of subdural hematomas, skull fractures, and structural changes, you are almost always in the realm of a moderate/severe TBI which has entirely different diagnostic criteria. _ By definition, the CT scan and MRI scan are normal in a mild TBI, thus, it is an "invisible injury." _ If you want to learn more about mild TBI then go read my blog by clicking the link in the bio See more

Wishing everyone a happy Saturday! _ Not sure if you knew but recently the Supreme Court of California rendered a decision that will make it harder for Ride Share companies to treat its drivers as independent contractors moving forward. _ In addition to possibly increasing costs and opening up Uber, Lyft and other similarly situated companies to labor law disputes, this new law could have a major impact on personal injury cases involving a ride share. ... _ Up to now, a person injured in a ride share is able to trigger the $1,000,000.00 policy that Uber/Lyft have in place to cover the injuries. However, if the driver becomes classified as an employee instead of an independent contractor then Uber may be held vicariously liable for the actions an employee commits during the scope of employment, which includes causing an accident while driving a car for Uber/Lyft. _ The takeaway: an injured party may be able to go around the 1M policy limit and sue Uber/Lyft directly for a much bigger pay out if the facts of the case can support it.
