Tyrone continues to break new ground and effect change for those who follow in his brave footsteps. Tyrone and I teamed up with Morrison & Foerster litigators Suzy Marinkovich and Ben Kagel to begin Tyrone’s appeal after his petition was denied by the Superior Court of San Diego County. Just this week, we scored a significant procedural victory by convincing the Court of Appeal and the Superior Court that AB-2298 petitions should not be treated as limited civil cases, mea...ning that an appeal would go to a Superior Court Judge. As a result of this victory, Mr. Simmons’s case will be reclassified as an unlimited civil case and will go directly to the California Court of Appeal. All AB-2298 petitions currently pending across California are classified as limited, so Tyrone’s procedural victory has the potential to change the appellate path for cases like his across the state of California. This means a more robust review and a chance to shape the law in a way that can restore the rights of thousands of people erroneously documented as gang members in law enforcement databases. A lot of movement on criminal justice reform!
This past Friday was emotional and disappointing. It was also groundbreaking and motivating. Despite what I think to be an excellent case, we lost our first Gang Database Removal Hearing. We will be appealing the decision. The law and facts are on our side and I think the Court of Appeal will agree. One bad ruling will not destroy this law and the rights it has afforded to those who previously could not combat the adverse effects of over-policing and surreptitious data g...athering. This ruling is a minor set back in a greater mission and allows us the opportunity to solidify this new law and rights conferred thereunder. The moratorium on the use of Cal Gangs remains and during that time I hope we can continue to challenge erroneous placement on shared gang databases. There are real adverse effects to documentation, not to mention the fundamental negative effect upon identity and self-definition. The community has embraced this legislation and I will do everything I can to make sure that people can exercise their rights to the full extent of the law. https://www.nbcsandiego.com//Local-Man-Appeals-to-Get-Off- Yesterday we saw a lot of hard work materialize -- for years, activists and community organizers have come together to spur change. The legislature acted and gave people the right to challenge their inclusion in shared gang databases. For the past year and a half, I've studied the new law; worked with brilliant people (like Aaron Harvey and Jess Jollett); met amazing affected persons; worked with my client (Tyrone Simmons) and yesterday we watched all that hard work turn into the first gang removal hearing in San Diego. The case is continued until March 23rd, but the community support and effort put in made yesterday's long hearing all worth it!
