Suppose that a practitioner representing a patent applicant-owner during prosecution comments in a docketing system that (1) an inventor stole the idea from a prior company, (2) believes that the claims aren't novel anyway, (3) the idea is so cockamamie that nobody would infringe it, (4) and even if they did, it would make their product less rather than more valuable, (5) the company started selling the invention 2 years before patenting it, (6) and by the way we hid some killer prior art from the examiner at the CEO's request. Can any of those comments be discovered in litigation or are all docketing system comments protected by privilege. ====================
