Does the new COVID-19 Tenant Relief Act of 2020 permit a tenant to remain in the property without paying rent through 1/31/21? Yes! As long as the tenant signs a declaration of financial distress. This applies to rent that was due between 3/1 and 8/31. For rent between 9/1 and 1/2021, the tenant must also pay 25% of the rent, but only by 1/31/21. In addition, the landlord is responsible for giving all tenants that are behind on rents from 3/1 to 8/31, a general notice advising the tenant of their rights.
