2020 has actually been a rewarding year for our clients at Houston Law of California. During the Covid "pandemic" and quarantine, HLC has been able to obtain millions of dollars in recoveries on behalf of several injured clients who needed both resolution and closure. Follow up to my Brain Injury trial that was supposed to start last Monday. Opposing counsel had a slight delay tactic that pushed us out a few days. We were supposed to report back to court on Friday (today) to start trial. Since i had an extra week, my co-counsel and i recruited some amazing people to conduct a last minute focus group on a few things. It was extremely insightful and gave a boost of confidence re: our case. Long story short, opposing counsel called me We...dnesday asking me to "help him" understand my valuation. I did a quick "clopening" statement with him. He said what you would expect him to say, and he simply tried to crunch numbers. Then he asked "what am i missing?" He didn't quite understand how i valued this case over $1M dollars. My response: "you are missing the HUMAN element. You are crunching numbers like they are data points, and you are forgetting about being a human being". Short story, he called me yesterday and paid my demand. Turns out there is extreme power and influence in simply being a "human being". And justice is served, once again. All are happy with the result. Thank you all for supporting the Trial Lab. One week ago tomorrow a jury came back with a verdict in my clients favor. I sued two attorneys for absolutely abusing the legal system and haraasing my client with lawsuit after lawsuit, even filing an appeal for an absolutely meritless claim. The trial court and appeallate courts agreed...they filed a frivolous lawsuit. Last week, a jury agreed. They awarded $184,000 in attorneys fees and emotional distress, and awarded an additional $384,000 in PUNITIVE damages, intend...ed to punish and deter this type of conduct. Justice was served and a message was sent to ALL OF US trial lawyers. Do not bring meritless (aka "frivolous") lawsuits. If you do, you will be held accountable. Initially it felt strange to sue attorneys, but the facts warranted it and the jury agreed. But that is all in the past. I start another trial TOMORROW, one week after my verdict. I haven't gone back to back like this, but i am ready. Here we go. Justice needs to be served, AGAIN. This time i represent a brain injured young man who was subjected to multiple and repeated hits to the head during football practice despite informing his coaches of head pain after the first hit. It resulted in a TBI and he had surgery three weeks later when his eyes started to cross as a result of bleeding inside his skull, between his brain and skull. They had to drain the blood, etc. Let's see how a jury feels about coaches backdating records and convening several meetings to "get their stories straight". Let's see how a jury feels about the defense attorney's fabricating alternate theories of how my client was injured when their own experts unequivocally agree that the injury was caused by the football head trauma. Hopefully the Orange County jury will see through their web of lies. It my job to make sure that happens. It all starts tomorrow. Here we go again....

Happy to report that today the California Court of Appeal granted my appeal on behalf of Clara Stokes and reversed the trial courts' errant decision to grant the defendants Motion for Summary Judgment. The end result is that my client will finally get a chance to have her case heard by a jury instead of the defendant getting away with medical negligence due to a judge's mistake in her interpretation of the law. The best part of this victory is that this opinion is certified... for publication, which means that it is the law of the land now in California. The issue involves Health and Safety Code 1799.110 and who is permitted to provide opinions regarding causation and damages re: negligence in an emergency room setting. It is an issue that has come up a few times in the past 40 years since the law was enacted under Gerry Brown's first term as governor back in 1975. But the court has never decided the issue on the merits, until now. This is a huge victory for patients who suffer negligence from a doctor in an emergency room setting. The interpretation by the trial court (that was reversed) would lead to "absurd results' which is exactly what I told the trial judge just before she dsmissed my clients case ... Now I have the Second District Court of Appeals also shouting back on behalf of my client. These victories are seldom achieved alone. Jason Caruso now from Newmeyer and Dillion (and my former colleague at my previous firm) took the laboring oar in writing the brief and arguing before the appellate court. He is an absolute monster when it comes to the poison pen and crushing judges gone wild from the bench. Huge kudos to Jason for this well deserved victory that I am privileged to have my name attached to. Without Jason, this justice never comes to my client. Stokes v. Baker, M.D. now the law of the land.

OK, let's try this again. Motions in Limine : DONE Jury Selection: DONE Opening Statements: Coming Monday!!!! ... This week Kevin Liebeck and I put The Trial Lab to the test. We picked a jury yesterday. We begin to seek justice for the family of Ernie Castellanos. "Junior" Monzon and Monzon Garage rebuilt Ernie's '63 Impala from bumper to bumper. Ernie was killed when the steering column of his car disconnected. Monzon's defense: We rebuilt the car....but not THAT part. Ernie's last words (with a broken jaw) to the police officer who arrived on scene: "My steering wheel didn't work"...and the police officer went to the 1963 Impala and spun the steering wheel like a roulette wheel. Ernie died 18 days later from his injuries. Here is a photo of Ernie and the owner of the garage who rebuilt the car. The defendant put this photo on Yelp, standing in front of his shop. Monzon Garage: "Nope...we had NUTHIN' to do with this car!!!!" Trial underway.

Adventure seekers beware and know before you off-road... The Yamaha Rhino which looks like a cross between a golf cart and an all-terrain vehicle, or ATV, is at the center of a legal firestorm. At least 59 riders have been killed in Rhino accidents, according to the Consumer Product Safety Commission. There are more than 440 wrongful death and personal injury lawsuits pending.
