This is great information for business owners.

I have had a few clients call me with coverage concerns related to Covid-19 so I thought I would reach out and let you know from the business insurance perspective, what I have learned. First, business insurance carriers (I am NOT addressing Health Insurance coverage) are now treating this virus as a 'pre-existing condition' because it would be impossible to know when and how anyone has been infected and who would be liable. What this means in practical terms is that if yo...u have a business event, retail store, hotel, restaurant, etc., and one of your clients or event attendees becomes sick with Covid-19, there is no bodily coverage afforded under the policy terms. With that said, while a client or attendee could file a claim against the business owner or event, and it would likely be dropped by the court, you could still incur out-of-pocket defense costs in the process. Second, this also applies to any event cancellation coverages and travel insurance coverages (from what I have learned today). Under normal conditions, sickness, weather, etc could be covered but with Pandemic status, the carriers will not and could not cover this exposure. If you do have an event scheduled (under 250 people) that you still wish to have, it might be a good idea to have some type of waiver of liability signed by each attendee. This should be discussed with our attorney friends. Obviously, this situation is changing daily (even hourly) and I know the insurance companies are conferring together to discuss coverage options for business owners that might have financial loss due to forced closure, loss of revenue, etc. This is a new challenging issue for the insurance arena and just as they did post 9/11, they will find insurance products that will offer Covid-19 coverage. 2020 brings with it new labor laws for business owners who have 1099 Subcontractors. The passed AB5 regulation requires special attention. If you have subs and are unclear on what this means for you, please look into this by calling your HR specialist, Insurance broker (hopefully us!) or the EDD directly for clarification. It can impact your business and the ramifications for not following the new set of rules can be severe. Ignorance is never an accepted excuse!
