At Castellón & Funderburk LLP, we represent some of the leading, most sustainable corporate and Environmental stewards in the world. Occasionally, our clients disagree with the government’s position or with that of community groups. We fight where the merits are justified (mostly the work of Rubén Castellon my partner of 28 years); we settle where the clients business interests are served by eliminating litigation and we try to align settlements with the interests of the co...mmunity (sometimes Ruben more often me in regulatory disputes). To mitigate risk, we try to monitor groups that may not be in the line of site of chief sustainability officers or the C suite. We develop litigation risk management protocols to cost efficiently address risks in coordination with a deep bench of reputable scientists with known reputations for being intellectually homiest. On stormwater compliance we pioneered flat fee billing of packaged technical, legal and regulatory services 30 years ago. In the climate space, we alerted clients twelve months ago that various activist and education groups were gaining widespread traction in the political middle. One of the direction action groups pulling business enterprises to the political center on climate was Extinction Rebellion. Sure enough, they’ve been a potent force. Our advice: whether on #decarbonization, #stormwater Capture or other organizational compliance, treat environmental costs as investments whether OpEx or CapEx. Align them with key performance indicators in the CFOs office to make durable change. Don’t just do the minimum even if 100% seems economically daunting and unachievable. Don’t just paper your file without action, goals and timelines. Competing in America as a manufacturer is hard but successful companies innovate and use the competitive advantage of cultural dexterity that few others nations have because of their homogeneity.

Evidence based policymaking and solutions temper overburdening regulation but protect the public from untrammeled market forces. I never fully comprehended this report by the National Climate Assessment. As someone whose parents and grandparents were small business owners (albeit under dehumanizing conditions in some cases), I have fought against efforts to push around the small guy and gal who make up the backbone of the country’s workforce. Climate seemed to distant even t...hough the science behind CO2 and the Keeling Curve seemed sound. Serving the city on the LADWP Board with exemplary corporate fiduciaries was the most satisfying work I’ve committed to in my life. I’m not a climate denier or a climate alarmist. But I do listen to science. I look forward to the day when there’s bipartisan action and just transition to decarbobuze. The NCA report is accessible but not widely publicized. Read it. Then comment. Sobering information in this overlooked 1000 page report from National Climate Assessment. They’re mandated at least every four years.
