This ruling overturns the 9th Circuit Court of Appeals and makes it harder to bring a civil lawsuit in police abuse cases.

This is not a Fox News story and is the best piece I have seen on this lawsuit. The entire court Complaint is included in the article for on screen reading or download. I would have added a cause of action (COA) for negligence (and maybe a couple other things) if it were my case for the following reasons: 1. Negligence is easier to prove than intentional causes of action; 2. Negligence is more of a "catch all" count in case the defendants are somehow able to wiggle out of the... intentional COAs; and 3. A Negligence COA invokes certain types of insurance policies that give the insurance company the right to direct and control the litigation, including settlement decisions. Moreover, insurance companies are more detached from the emotional aspects and will often take a more reasonable arm's-length posture than defendants who hire their own counsel and direct the litigation.
