New Asylum Rules Published Eviscerating Asylum The Department of Homeland Security, (DHS) and Department of Justice (DOJ) have published regulations on December 10th that drastically restrict eligibility for asylum, withholding of removal, and protection under the Convention Against Torture and will take effect on Jan.11, 2021. The regulations will only apply prospectively, to applications filed on or after the effective date, January 11, 2021. Here are the most significa...nt changes: 1) Allowing immigration judges to pretermit asylum applications, meaning immigration judges would not need to hold an individual hearing if they believe the applicant’s application does not make out a prima facie case; 2) Narrowing the definitions of particular social group and political opinion; 3) Defining persecution for the first time, and emphasizing that the harm must be severe; 4) Increasing the burden to prove nexus, and in general it directs immigration judges and asylum officers to do deny broad types of asylum claims, such as those based on domestic violence and gang violence, with few exceptions. 5) Increasing the burden to prove that an applicant cannot safely relocate internally; 6) Adding negative discretionary factors, including: Entering without inspection, Failing to seek asylum in a transit country, Spending more than 14 days in a country of transit, Accruing more than one year of unlawful presence in the United States, and Failing to pay taxes in the United States; 7) Increasing the burden of proving that the applicant has not firmly resettled in a third country; 8) Expanding the definition of frivolous asylum applications; 9) Making it more difficult to prove government acquiescence in Convention Against Torture cases; and 10) Making it more difficult to succeed in Credible fear interviews. The court's decision is based on its earlier ruling that acting DHS Secretary Chad Wolf was not lawfully serving in that position, so the July memorandum was not lawfully issued. USCIS announc...ed in the evening of Monday, Dec. 7, 2020, that it is now accepting the following applications and that they will be adjudicated based on the terms of the DACA policy in effect before its attempted termination on Sept. 5, 2017: Initial or first-time DACA applications (Form I-821D); Renewal DACA applications; and Advance Parole (Form I-131) applications for DACA recipients. USCIS is also taking the following actions based on the judge's Order: Extending the 65,800 one-year grants of deferred action under DACA to two years; and Extending one-year employment authorization documents under DACA to two years. The court's Order requires USCIS to provide evidence of these extensions to all DACA recipients who received one-year grants on or after July 28, 2020. DHS Public Charge Rule Enjoined Again A district court judge in Illinois has blocked the Department of Homeland Security once again from implementing its public charge rule in Cook County, Illinois, et al v. Wolf et. al., (19-cv-6334). As of Nov. 2, 2020, the agency can no longer require applicants to submit the Form I-944, Declaration of Self-Sufficiency, with their adjustment of status application. The injunction is to be applied on a nationwide basis. However, the governme...nt might appeal this decision and seek a stay of its enforcement. At the present time, the USCIS has not updated its website to incorporate this most recent decision nor has it blocked access to Form I-944. There will an 81% percent increase with citizenship filings, as USCIS will now charge $1170 for the filing fee. This final rule also encourages online filing by providing a $10 reduction in the fee for applicants who submit forms online that are electronically available from USCIS.
